THE PRESIDENTIAL (EMOLUMENTS)
(AMENDMENT) BILL, 2011

MEMORADUM

The object of this Bill is to amend the Presidential (Emoluments) Act so as
to—

(a) revise the criterion for payment of gratuity to a person who has held
the office of President; and

(b) provide for matters connected with, or incidental to, the foregoing.

An Act to amend the Presidential (Emoluments)
Act.

ENACTED by the Parliament of Zambia.

1. This Act may be ci ted as the Presidential
(Emoluments) (Amendment) Act, 2011, and shall be read
as one with the Presidential (Emoluments) Act, in this Act
referred to as the principal Act.

2. The principal Act is amended by the repeal of section
three and the substitution therefor of the following:

3. (1) A person who has held the office of
President shall, upon the expiration of a term of office
or upon ceasing to be President, be paid a gratuity
equal to one hundred percent of the aggregate amount
of emoluments paid or payable to the person in respect
of the period spent in office.

(2) Where a person who holds office of President
ceases to hold office—

(a) by reason of death; or

(b) when a new President assumes office after
an election following the dissolution of Par-
liament before its full term;

that person shall be deemed to have served as President
for the purpose of this section.
