DECISION No. 88/2000/QD-BTM OF JANUARY 18, 2000 PROMULGATING THE DETAILED LIST OF GOODS BANNED FROM CIRCULATION, COMMERCIAL SERVICES BANNED FROM PROVISION; GOODS AND SERVICES SUBJECT TO RESTRICTED BUSINESS OR CONDITIONAL BUSINESS

THE MINISTER OF TRADE

Pursuant to the Government’s Decree No.95/CP of December 4, 1993 stipulating the functions, tasks, powers and organizational structure of the Ministry of Trade;

Pursuant to the Government’s Decree No.11/1999/ND-CP of March 3, 1999 on goods banned from circulation, commercial services banned from provision; goods and services subject to restricted business or conditional business;

Pursuant to the Government Office’s Official Dispatch No.5126/VPCP-KTTH of November 8, 1999 announcing the Prime Minister’s opinions on authorizing the Minister of Trade to promulgate the detailed list of goods banned from circulation, commercial services banned from provision; goods and services subject to restricted business or conditional business,

DECIDES:

Article 1.- To promulgate together with this Decision the "detailed list of goods banned from circulation, commercial services banned from provision; goods and services subject to restricted business or conditional business" according to provisions of the Government’s Decree No.11/1999/ND-CP of March 3, 1999.

Article 2.- This Decision takes effect 15 days after its signing.

DETAILED LIST OF GOODS BANNED FROM CIRCULATION, COMMERCIAL SERVICES BANNED FROM PROVISION; GOODS AND SERVICES SUBJECT TO RESTRICTED BUSINESS OR CONDITIONAL BUSINESS

(Promulgated together with the Minister of Trade’s Decision No.88/2000/TM-QD of January 18, 2000)

THE FIRST PART

LIST OF GOODS BANNED FROM CIRCULATION, COMMERCIAL SERVICES BANNED FROM PROVISION

I. WEAPONS, AMMUNITIONS, MILITARY EQUIPMENT AND GEARS, SPECIAL-USE TECHNICAL MEANS OF THE ARMED FORCES

(the Ministry of Defense’s Official Dispatch No.1243/BQP of May 11, 1999)

1. Weapons and ammunitions:

- Guns and cannons of all kinds.

- Weapons of special categories of such forces as Commando, Special Task Force, Reconnaissance, Intelligence, Military Chemical Engineering, Sapper, Electronic Operations, Special Propaganda.

- Military aircraft and aviation equipment of all kinds.

- Military missiles and projectile fuels of all kinds.

- Tanks, armored vehicles, motorized infantry vehicles, amphibious vehicles, self-propelled cannons, project vehicles and machines of the sapper.

- Warships and operational ships of all kinds.

- Bullets, bombs, mines, grenades, hand-grenades, water mines, torpedoes of all kinds and spare parts thereof.

2. Special-use military technical equipment:

- Radar of all kinds (radar for observation, warning, guiding, take-off and landing of aircraft, meteorology...), control apparatus of all kinds for military use.

- Specialized vehicles and machines of all kinds, command vehicles for special military use.

- Electrical engineering vehicles and machines and project vehicles of all kinds for special military use.

- Vehicles for hauling artilleries, tanks, missiles (caterpillars or rubber-tire wheels).

- Military equipment for reconnaissance, range-finding, jamming, camouflaging and anti-chemical warfare.

- River-going, mine-sweeping and radio activity-measuring military equipment.

- Military communication machines of all kinds.

- Spare parts for special-use technical means.

- Technical documents for manufacture, repair and modification of weapons and military technical equipment.

- Documents related to military secrets.

- Machinery and equipment in complete sets, to be used exclusively for the manufacture and repair of weapons and military technical equipment.

- Laboratories, and pilot research and experiment of weapons and military technical equipment.

3. Military attire and gears and other military equipment:

- Military uniforms of all kinds, service insignia, service emblem and rank badge for officers, career military personnel, non-commissioned officers and soldiers.

- Assorted military gears and equipment manufactured according to the uniformly designed models of the army.
