DECISION No. 110/2000/QD-BNN-TCCB OF OCTOBER 26, 2000 ASSIGNING THE APPROVAL OF COST ESTIMATES AND BIDDING PLANS, CONSULTANCY BID EVALUATION RESULTS OF FOREST PROTECTION AND RURAL DEVELOPMENT PROJECTS
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Government’s Decree No. 73/CP of November 1, 1995 on the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Government’s Decree No. 52/1999/ND-CP of July 8, 1999 promulgating the Regulation on Investment and Construction Management;
Pursuant to the Government’s Decree No. 88/1999/ND-CP of September 1, 1999 promulgating the Regulation on Bidding;
Pursuant to the Agriculture and Rural Development Minister’s Decision No. 71/1999/QD-BNN-TCCB of May 3, 1999 promulgating the Regulation on organizing the implementation of forest protection and rural development projects;
Pursuant to the Agriculture and Rural Development Minister’s Decision No. 179/1999/QD-BNN-TCCB of December 27, 1999 assigning the approval of cost estimates of forest protection and rural development projects;
At the proposal of the Chairman of the Board of Management of Forestry Projects in Official Dispatch No. 743 CV/DALN-WB1 of September 22, 2000;
At the proposals of the directors of the Department for Organization and Personnel, the Department for Capital Construction Investment and the Finance-Accounting Department,
DECIDES:
Article 1.- To assign the People’s Committees of the provinces where projects exist:
1. To approve the cost estimates, bidding plans, bid evaluation results and service contracts on land use planning and land allocation, forest protection contracting, agricultural and forestry promotion on the basis of current expenditure norms set by the General Land Administration and the guiding documents of the Ministry of Agriculture and Rural Development on field activities.
2. To approve the cost estimates, bidding plans, bid evaluation results and service contracts for other expenditures on construction works valued at VND 1 billion or under and the procurement of goods valued at VND 500 million or under on the basis of the plan already approved by the Ministry of Agriculture and Rural Development.
3. To approve contracts signed between the provincial project management boards and mass organizations in the project areas for the construction or repair of grade IV-houses; roads of technical grade 20, valued at VND 100 million or under, on the basis of the plan already approved by the Ministry of Agriculture and Rural Development.
4. To approve communal action plans of the communes in the project areas within the framework of the project operation contents after obtaining comments of the World Bank and the Central Project Management Board.
Article 2.- Before submitting to the provincial People’s Committees for decision, the provincial Project Management Boards should consider and compare with the already signed agreements, the World Bank’s regulations, the State’s regulations and written opinions of the Central Project Management Board.
Article 3.- This Decision takes effect 15 days after its signing.
Article 4.- The director of the Ministry’s Office, the directors of the Department for Organization and Personnel, the Finance-Accounting Department, the Department for Capital Construction Investment, the heads of the concerned units, the heads of the forestry projects management boards, the central and local forest protection and rural development project management boards shall have to implement this Decision.
