DECISION No. 29/2004/QD-BKHCN OF OCTOBER 27, 2004 ON MANAGEMENT OF THE QUALITY OF CRASH HELMETS FOR CHILDREN JOINING IN TRAFFIC ON MOTORCYCLES AND MOTORBIKES

THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to the December 24, 1999 Ordinance on Goods Quality;

Pursuant to the Government's Decree No. 54/2003/ND-CP of May 19, 2003 defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology and Decree No. 28/2004/ND-CP of January 16, 2004 amending and supplementing a number of articles of Decree No. 54/2003/ND-CP of May 19, 2003;

Pursuant to Resolution No. 10/2001/NQ-CP of August 31, 2001 on the Government's August 2001 regular meeting;

At the proposal of the general director of the General Department of Standardization, Metrology and Quality Control,

DECIDES:

Article 1.- Home-made crash helmets for children are goods subject to compulsory publicization of compatibility with Vietnam standard TCVN 6979:2001 "Crash helmets for children joining in traffic on motorcycles and motorbikes".

Article 2.- The publicization of children crash helmets' compatibility with TCVN 6979:2001 and the testing of typical specimens of crash helmets for children shall comply with the provisions of Decision No. 51/2001/QD-BKHCNMT of October 8, 2001 of the Minister of Science, Technology and Environment (now the Minister of Science and Technology).

The list of organizations designated to test the quality of home-made crash helmets for children is in the Appendix to Decision No. 51/2001/QD-BKHCNMT.

Article 3.- Imported crash helmets for children must conform to Vietnam standard TCVN 6979:2001 or the exporting country's national standard on crash helmets, which is equivalent to the Vietnam standard.

Article 4.- The control of the quality of imported crash helmets for children shall comply with the provisions of Decision No. 52/2001/QD-BKHCNMT of October 8, 2001 of the Minister of Science, Technology and Environment (now the Minister of Science and Technology).

Domestic and foreign certifying organizations/testing laboratories which control the quality of imported crash helmets for children are organizations designated by the General Department of Standardization, Metrology and Quality Control to control the quality of crash helmets used for adults.

Article 5.- The control of the quality of children's crash helmets circulated on the market shall comply with common regulations on control of the quality of goods circulated on the market.

Article 6.- This Decision takes effect 15 days after its publication in the Official Gazette.

The concerned agencies, organizations and individuals and the General Department of Standardization, Metrology and Quality Control shall have to organize and guide the implementation of this Decision.

Domestic enterprises which produce and/or import crash helmets for children shall have to implement this Decision.
