STATUTORY AUTHORITY:
KRS 194.030(13)
NECESSITY, FUNCTION,
AND CONFORMITY: Title V of the Social Security Act, as amended by PL 97-35,
authorizes grants to states to provide services to children who are handicapped
or who are suffering from conditions leading to a handicap. KRS 200.460 to
200.490 authorize the Commission for Children with Special Health Care Needs to
provide services for handicapped children. The terms "crippled" and
"handicapped" as used in applicable federal and state laws are deemed
to be synonymous as used in this administrative regulation. The Commission for
Children with Special health Care Needs is authorized by KRS 194.030(13) to
adopt such administrative regulations as are necessary to implement programs
authorized by federal law so as to qualify for the receipt of federal funds and
as are necessary to cooperate with federal agencies for the proper
administration of the commission and its programs. The function of this
administrative regulation is to implement the Kentucky Commission for Children
with Special Health Care Needs in accordance with applicable federal and state
laws and regulations.
Section 1. Crippled
Children's Services Program Standards. The Commission for Children with Special
Health Care Needs hereby adopts the "Crippled Children's Services Program
Standards" dated May, 1984 by reference as covering all phases of program
operation including but not limited to program eligibility for services, fee
collections, consent requirements, medical standards, and other relevant
components of the program. A copy of the "Crippled Children's Services
Program Standards" shall be on file and available for public inspection in
the Office of the Commission for Children with Special Health Care Needs, 310
