§15104-B. Appeals; variances

§15104-B. Appeals; variances






A person aggrieved by an order or act of the chief inspector or a deputy inspector
under this chapter may, within 15 days after notice of the order or act, appeal from
the order or act to the director, who shall hold a hearing pursuant to Title 5, chapter 375, subchapter 4. After the hearing, the director shall issue an appropriate order either approving or disapproving the order or act. [2013, c. 70, Pt. C, §12 (AMD).]






A person who is or will be aggrieved by the application of any law, code or rule relating
to the installation or alteration of boilers and pressure vessels may file a petition
for a variance, whether compliance with that provision is required at the time of
filing or at the time that provision becomes effective. The filing fee for a petition
for a variance must be set by the director under section 15104-C. The chief inspector may grant a variance if, owing to conditions
especially affecting the particular boiler or pressure vessel involved, the enforcement
of any law, code or rule relating to boilers or pressure vessels would do manifest
injustice or cause substantial hardship, financial or otherwise, to the petitioner
or would be unreasonable under the circumstances as long as desirable relief may be
granted without substantial detriment to the public good and without nullifying or
substantially derogating from the intent or purpose of that law, code or rule. In
granting a variance under this section, the chief inspector may impose limitations
both of time and of use, and a continuation of the use permitted may be conditioned
upon compliance with rules made and amended from time to time. A copy of the decision
