(a) A person may request the Commission to adopt, amend, or
repeal a rule by filing the request in writing with the executive secretary.
(b) The request must include:
(1) the full name, address, and telephone number of the person
making the request;
(2) the text of the new section or amendment, or a reference
to the section proposed for repeal, identified in a manner sufficient to show
the context of the new section, amendment, or repeal;
(3) a suggested effective date;
(4) reasons for the proposed action in narrative form in sufficient
detail to inform the Commission fully of the facts on which the person relies;
(5) the desired effect of the proposed section, amendment,
or repeal;
(6) the fiscal implications of the proposed section, amendment,
or repeal to the state, to units of local government, to small businesses,
and to individuals, if any; and
(7) the signature of the person or a representative of the
person.
(c) The executive secretary shall inform the Chair of the Commission
of each petition for rulemaking filed. The Chair shall determine whether to
place the petition on the agenda for a Commission meeting for consideration
by the Commission.
(d) Not later than the 60th day after the date a petition under
this section is submitted, a state agency shall:
(1) deny the petition in writing, stating its reasons for the
denial; or
(2) initiate a rulemaking proceeding under this subchapter.
