      NECESSITY, FUNCTION, AND CONFORMITY: KRS

439.330(1)(g) establishes the authority of the Parole Board to grant a final

discharge from parole.

 

      Section 1. If an offender paroled prior

to July 15, 1998, reaches the maximum expiration date of his sentence, a final

discharge from parole shall be issued automatically by the board.

 

      Section 2. (1) If an offender paroled on

or after July 15, 1998, owes restitution, he shall not automatically receive a

final discharge from parole upon reaching the maximum expiration of his

sentence.

      (2) The board shall not issue a final

discharge to a parolee until he pays restitution in full.

      (3) Verification of payment of

restitution shall be obtained from the parole officer. (15 Ky.R. 1193; eff.
