      STATUTORY AUTHORITY:

KRS 194.050, 202A.191, 202A.196, 202B.060, 210.010, 210.040, 210.045, 210.055,

210.285, 42 C.F.R. 440-489, EO 2004-726

      NECESSITY, FUNCTION,

AND CONFORMITY: EO 2004-726, effective July 9, 2004, created the Cabinet for

Health and Family Services and placed the Department for Mental Health and

Mental Retardation within the cabinet. KRS 210.010, directs that the Secretary

for the Cabinet for Health and Family Services shall adopt rules and

regulations which insure proper administration and enforcement of these

chapters.

 

      Section 1. Policies

and procedures of Oakwood as set forth in Volume I, Organization, dated July

15, 1990; Volume II, Interdisciplinary Team Process, dated November 15, 1991;

Volume III, General Facility, dated November 15, 1992; Volume IV, Residents'

Rights, dated May 1, 1988; and Volume V, Social Work Services/Resident Record

Department, dated July 1, 1986, relating to the operation of Oakwood are incorporated

by reference.

 

      Section 2. These

policies and procedures are available for inspection and copy at the office of

the Commissioner of the Department for Mental Health/Mental Retardation
