      NRS 482A.010  Definitions.  As

used in this chapter, unless the context otherwise requires, the words and

terms defined in NRS 482A.025, 482A.030 and 482A.040

have the meanings ascribed to them in those sections.

      (Added to NRS by 2011, 2876;

A 2013,

2010)

      NRS 482A.020  “Artificial intelligence” defined.  Repealed.

(See chapter 377, Statutes of Nevada 2013, at page 2010.)

      NRS 482A.025  “Autonomous technology” defined.  “Autonomous

technology” means technology which is installed on a motor vehicle and which

has the capability to drive the motor vehicle without the active control or

monitoring of a human operator. The term does not include an active safety

system or a system for driver assistance, including, without limitation, a

system to provide electronic blind spot detection, crash avoidance, emergency

braking, parking assistance, adaptive cruise control, lane keeping assistance,

lane departure warning, or traffic jam and queuing assistance, unless any such

system, alone or in combination with any other system, enables the vehicle on

which the system is installed to be driven without the active control or

monitoring of a human operator.

      (Added to NRS by 2013, 2009)

      NRS 482A.030  “Autonomous vehicle” defined.  “Autonomous

vehicle” means a motor vehicle that is equipped with autonomous technology.

      (Added to NRS by 2011, 2876;

A 2013,

2010)

      NRS 482A.040  “Highway” defined.  “Highway”

means the entire width between the boundary lines of every way dedicated to a

public authority when any part of the way is open to the use of the public for

purposes of vehicular traffic, whether or not the public authority is

maintaining the way.

      (Added to NRS by 1969, 1478; A 1981, 1690)

      NRS 482A.050  “Sensors” defined.  Repealed.

(See chapter 377, Statutes of Nevada 2013, at page 2010.)

      NRS 482A.060  Testing autonomous vehicle: Requirement for insurance or bond.  Before a person or entity begins testing an

autonomous vehicle on a highway within this State, the person or entity must:

      1.  Submit to the Department proof of

insurance or self-insurance acceptable to the Department in the amount of

$5,000,000; or

      2.  Make a cash deposit or post and

maintain a surety bond or other acceptable form of security with the Department

in the amount of $5,000,000.

      (Added to NRS by 2013, 2009)

      NRS 482A.070  Testing autonomous vehicle: Requirements for safety and control

of vehicle.  If an autonomous

vehicle is being tested on a highway within this State, a human operator must

be:

      1.  Seated in a position which allows the

human operator to take immediate manual control of the autonomous vehicle;

      2.  Monitoring the safe operation of the

autonomous vehicle; and

      3.  Capable of taking over immediate manual

control of the autonomous vehicle in the event of a failure of the autonomous

technology or other emergency.

      (Added to NRS by 2013, 2009)

      NRS 482A.080  Vehicle to meet federal standards and regulations for

registration; requirements for testing or operating upon highways in this

State.

      1.  An autonomous vehicle shall not be

registered in this State unless the autonomous vehicle meets all federal

standards and regulations that are applicable to a motor vehicle.

      2.  An autonomous vehicle shall not be

tested or operated on a highway within this State unless the autonomous vehicle

is:

      (a) Equipped with a means to engage and disengage

the autonomous technology which is easily accessible to the human operator of

the autonomous vehicle;

      (b) Equipped with a visual indicator located

inside the autonomous vehicle which indicates when autonomous technology is

operating the autonomous vehicle;

      (c) Equipped with a means to alert the human

operator to take manual control of the autonomous vehicle if a failure of the

autonomous technology has been detected and such failure affects the ability of

the autonomous technology to operate safely the autonomous vehicle; and

      (d) Capable of being operated in compliance with

the applicable motor vehicle laws and traffic laws of this State.

      (Added to NRS by 2013, 2009)

      NRS 482A.090  Manufacturer not liable for certain damages.  The manufacturer of a motor vehicle that has

been converted by a third party into an autonomous vehicle is not liable for

damages to any person injured due to a defect caused by the conversion of the

motor vehicle or by any equipment installed to facilitate the conversion unless

the defect that caused the injury was present in the vehicle as originally

manufactured.

      (Added to NRS by 2013, 2009)

      NRS 482A.100  Adoption of regulations to authorize operation; requirements.

      1.  The Department shall adopt regulations

authorizing the operation of autonomous vehicles on highways within the State

of Nevada.

      2.  The regulations required to be adopted

by subsection 1 must:

      (a) Set forth requirements that an autonomous

vehicle must meet before it may be operated on a highway within this State;

      (b) Set forth requirements for the insurance that

is required to test or operate an autonomous vehicle on a highway within this

State;

      (c) Establish minimum safety standards for

autonomous vehicles and their operation;

      (d) Provide for the testing of autonomous

vehicles;

      (e) Restrict the testing of autonomous vehicles

to specified geographic areas; and

      (f) Set forth such other requirements as the

Department determines to be necessary.

      (Added to NRS by 2011, 2876)

      NRS 482A.200  Endorsement on driver’s license to operate; regulations.  The Department shall by regulation establish a

driver’s license endorsement for the operation of an autonomous vehicle on the

highways of this State. The driver’s license endorsement described in this

section must, in its restrictions or lack thereof, recognize the fact that a

person is not required to actively drive an autonomous vehicle.
