§

568. Penalties

(a) Any person

who knowingly violates any provisions of this chapter or the rules adopted

under this chapter or who knowingly fails or refuses to obey or comply with any

order or the terms or conditions of any permit issued in accordance with this

chapter, shall be fined not more than $100,000.00 or be imprisoned not more

than five years, or both. Each violation may be considered a separate and

distinct offense and, in the case of a continuing violation, each day's

continuance may be deemed a separate and distinct offense. These penalties

shall not apply to violations of section 563 of this title.

(b) Any person

who knowingly makes any false statement, representation or certification in any

application, record, report, plan or other document filed or required to be

maintained under this chapter, or by any permit, rule, regulation or order

issued under this chapter, or who falsifies, tampers with, or knowingly renders

inaccurate any monitoring device or method required to be maintained under this

chapter or by any permit, rule, regulation, or order issued under this chapter,

shall upon conviction, be punished by a fine of not more than $50,000.00 or by

imprisonment for not more than one year, or by both. Each violation may be

considered a separate and distinct offense and, in the case of a continuing

violation, each day's continuance may be deemed a separate and distinct
