investigators. Bureau investigators shall have the power to execute arrest warrants and search warrants for the same criminal violations, serve subpoenas issued for the examination, inves- tigation, and trial of all offenses identified through their investigations, and arrest upon prob- able cause without warrant a person found in the act of committing a violation of the provi- sions of this chapter.

Sec. 9. CREATION OF INSURANCE FRAUD BUREAU CONTINGENT UPON FUND- ING. The creation of an insurance fraud bureau within the insurance division shall only be implemented, and this Act shall only be effective, if the state receives a federal grant for its implementation and the general assembly appropriates matching funds from the general fund of the state for its implementation.

AN ACT authorizing cities to assess and collect fees for connection to a sewer or water utility.

Be It Enacted by the General Assembly of the State of Iowa:

Section 1. Section 384.38, Code 1993, is amended by adding the following new subsection: NEW SUBSECTION. 3. A city may establish, by ordinance after notice and a public hear-

ing consistent with the requirements of section 384.50, one or more districts and schedules of fees for the connection of property to the city sewer or water utility. Each person whose property will be served by connecting to the city sewer or water utility shall pay a connection fee to the city. The ordinance shall be certified by the city and recorded in the office of the county recorder of the county in which a district is located. The connection fees are due and payable when a utility connection application is filed with the city. A connection fee shall not exceed the equitable part of the total original cost to the city of extending the utility to the properties within the district, less any part of the cost which has been previously assessed or paid to the city under this division IV. All fees collected under this subsection shall be paid to the city treasurer. The moneys collected as fees shall only be used for the purposes of oper- ating the utility, or to pay debt service on obligations issued to finance improvements or exten- sions to the utility.
