Rule §156.233 Evidence By Affidavit

The arbitrator may receive and consider evidence of witnesses
by affidavit. Affidavit testimony must be filed with the arbitrator
and served on the other party no later than 30 days before the hearing.
The other party will have 15 days to file any objection to the admissibility
of the affidavit or to file controverting affidavits. The arbitrator
shall give such evidence only such weight as the arbitrator deems
it entitled to after consideration of any objection made to its admission.
