Active military duty, expiration of driver's license during, renewal without examination, when--rulemaking authority.
302.186. 1. Notwithstanding any other law, if the driver's license of
any person expires while such person is on active duty in the Armed Forces of
the United States, the license of such person shall be renewable, without
examination, at any time prior to the end of the sixth month following the
discharge of such person from the Armed Forces, or within ninety days after
reestablished residence within the state, whichever time is sooner. Missouri
residents on active duty in the Armed Forces of the United States or any
dependent thereof age twenty-one or older residing outside the state of
Missouri or the United States may renew their driver's license by mail.
2. The department of revenue may promulgate rules necessary to implement
the provisions of this section. Any rule or portion of a rule, as that term
is defined in section 536.010, that is created under the authority delegated
in this section shall become effective only if it complies with and is subject
to all of the provisions of chapter 536 and, if applicable, section 536.028.
This section and chapter 536 are nonseverable and if any of the powers vested
with the general assembly pursuant to chapter 536 to review, to delay the
effective date, or to disapprove and annul a rule are subsequently held
unconstitutional, then the grant of rulemaking authority and any rule proposed
or adopted after August 28, 2011, shall be invalid and void.
