Automatic revocation of license, when--automatic reinstatement, when--automatic denial of license, when.
340.274. 1. A license issued under sections 340.200 to 340.330 shall be
automatically revoked following a review of the record of the proceedings by
the board and upon a formal motion of the board:
(1) When the final trial proceedings are concluded where a person has
been adjudicated and found guilty, or has entered a plea of guilty or nolo
contendere whether or not a sentence is imposed:
(a) In a felony criminal prosecution under the laws of this state, the
laws of any other state, territory or district of the United States, or the
United States for any offense reasonably related to the qualifications,
functions or duties of the person licensed under sections 340.200 to 340.330;
(b) For any felony offense, for which an essential element is fraud,
dishonesty or an act of violence; or
(c) For any felony offense involving moral turpitude;
(2) Upon the final and unconditional revocation or surrender of the
person's license to practice the same profession in another state, territory
or district of the United States upon grounds for which revocation is
authorized in this state.
2. The license of such person shall be automatically reinstated if the
conviction, judgment or revocation is set aside upon final appeal in any
court of competent jurisdiction.
3. Any person who has been denied a license, certificate, permit or
other authority to practice a profession in another state, if such profession
in this state is regulated pursuant to sections 340.200 to 340.330, shall
automatically be denied a license to practice such profession in this state;
however, the board may establish qualifications whereby such person may be
qualified and licensed to practice such profession in this state.
