(a) For waiver recipients with community spouses, the income and resource eligibility requirements are determined in accordance with the spousal impoverishment provisions in the Social Security Act, §1924, and as specified in the Medicaid state plan and in §48.6007 of this title (relating to Financial Eligibility Criteria). (b) After the recipient is determined to be eligible for Medicaid, a determination is made by the Texas Department of Human Services regarding the amount of the recipient's income applicable to payment.
