SECTION .0200 ‑ PENALTIES

 

01 NCAC 04A .0201          IMPOUNDMENT AND REMOVAL

(a)  Any vehicle parked in violation of these rules and

regulations will be subject to impoundment and removal (towed away) at the

expense of the owner.  Such removal shall be to a place of storage operated by

a privately‑owned garage or towing service.  A towing fee shall be paid

to the towing service before such vehicle is released to the owner.  The

provision of the Code of the City of Raleigh and the applicable state law

permitting such removal have been complied with in that the entrance to each

parking lot contains the proper warning signs.

(b)  If a call is made for towing services and the owner (or

person having control of the vehicle to be towed) returns to the unattended

vehicle before the arrival of the towing vehicle and the unattended vehicle is

not, in fact, towed in, a service charge for answering such a call shall be

paid to the towing service by the owner/operator before the vehicle can be

released from custody.

SECTION .0700 ‑ DEFINITIONS

 

01 NCAC 04A .0701          STATE PARKING COORDINATOR

The State Parking Coordinator is the person in state

government who is responsible for supervising the daily operations of the state‑owned

visitor parking lots.

01 NCAC 04A .0702          SERVICE PERSONNEL

Service personnel means any person who is an employee of the

State of North Carolina and whose duties include repair, maintenance or

installation of equipment necessary for the continued operation of state

buildings or offices or any person who has a contractual arrangement with the

state for the same.  Such person may remain on the premise only until such time

as the requested services are completed.

01 NCAC 04A .0703          HONOREES AND APPOINTEES

A honoree or appointee is any person who is to be specially

recognized by the Governor of North Carolina with a mark, token, plaque or

gesture of respect or distinction and requests the use of the state‑owned

parking lot immediately before, during and after the ceremony at which he or

she is to be distinguished.

A volunteer is an individual(s) who performs services for

the State of North Carolina without remuneration and of his or her free will.

SECTION .0800 ‑ STATE‑OWNED VISITOR PARKING LOTS

ADMITTANCE PROCEDURES

 

01 NCAC 04A .0801          LOCATION AND HOURS OF OPERATION

State‑owned visitor parking lots are located in the

downtown area at 400 Salisbury Street and on the corner of Wilmington and

Edenton Streets, Raleigh, North Carolina.  The hours of operation are from 8:00

a.m. ‑ 5:00 p.m. Monday through Friday.

01 NCAC 04A .0802          REASONABLE FEE CHARGE

(a)  Visitors seeking entrance to the Visitor Parking

locations will be charged a reasonable fee.

(b)  Persons determined by the State Parking Coordinator to

be performing a benefit or service to the State of North Carolina are exempt

from payment of an entrance fee.  Persons include but are not limited to

volunteers with current identification cards, docents, pages, service

personnel, appointees and honorees of the Governor.

01 NCAC 04A .0803          RESERVATION OF PARKING SPACES BY THE

PUBLIC

Advance reservation of parking spaces by visitors are

prohibited. Exception is extended to honorees and appointees of the Governor of

the state and to persons transporting kindergarten children to the State

Government Complex for a school related activity.  Arrangements by school

personnel, honorees and appointees are to be made through the State Parking

Coordinator prior to arrival.

01 NCAC 04A .0804          OFFICIAL PARKING SPACES

A specific number of parking spaces located in Visitor

Parking are reserved for official use only.  The Governor of the State of North Carolina or the Governor's designee has discretion in prescribing proper procedure

for use of the reserved spaces by approved individuals.

01 NCAC 04A .0805          INFORMATION VERIFICATION

Persons exempt from payment of an entrance fee to the

visitor parking lots are required to place on the ticket information sufficient

enough to determine that person's exemption status.  To ensure that the privilege

of parking without fee is not abused, the state parking coordinator reserves

the right to inquire into the accuracy of the information obtained.

01 NCAC 04A .0806          UNAUTHORIZED VEHICLES

Buses will be refused entrance to the facilities.

SECTION .0900 ‑ PARKING VIOLATIONS

 

01 NCAC 04A .0901          ENFORCEMENT OF RULES

(a)  The State Parking Coordinator shall notify the state

government security of parking violations occurring in Visitor Parking

locations.

(b)  Enforcement of these rules shall be the responsibility

of state government security.
