Kentucky Family Planning Program.

STATUTORY
AUTHORITY: KRS 194.050(1), 211.090, 211.180
NECESSITY,
FUNCTION, AND CONFORMITY: PL 91-572, the "Family Planning Services and
Population Research Act of 1970" and 42 CFR, Part 59, authorizes grants
for family planning services. The Cabinet for Human Resources is authorized by
KRS 194.050 to adopt such rules and administrative regulations as are necessary
to implement programs mandated by federal law, or to qualify for the receipt of
federal funds and as are necessary to cooperate with federal agencies for the
proper administration of the cabinet and its programs. The function of this
administrative regulation is to implement the Kentucky Family Planning Program
in accordance with applicable federal laws and regulations.
Section 1. State
Plan for Family Planning Services. The Cabinet for Human Resources hereby
adopts the "Kentucky State Plan for Family Planning Services - Fiscal Year
1988-1989," and the "Kentucky State Plan for Family Planning Services
- Fiscal Year 1987-1988,"by reference as the Kentucky Family Planning
administrative regulation covering all phases of program operation including
but not limited to program eligibility for services and provision for fee
collections in accordance with federal regulations and guidelines, consent
requirements, medical standards, quality assurance, and other relevant
components of the program. A copy of the "Kentucky State Plan for Family
Planning Services - Fiscal Year 1988-1989," and the "Kentucky State
Plan for Family Planning Services - Fiscal Year 1987-88" has been filed
with Region IV, Department of Health and Human Services, 101 Marietta Tower,
Atlanta, GA 30323. A copy shall be on file and available for public inspection
in the Office of the Commissioner for Health Services, 275 East Main Street,
