      STATUTORY AUTHORITY:

KRS 241.060

      NECESSITY, FUNCTION,

AND CONFORMITY: By the express provision of KRS 241.060(2), the board is

granted the right to limit the number and types of license issued for the sale

of alcoholic beverages. This administrative regulation establishes the

limitation on wholesale liquor licenses, such limitation begin based upon the

number of licenses issued by the Department of

Alcoholic Beverage Control for the sale of distilled spirits and/or wine at retail.

 

      Section 1. The

number of wholesale distilled spirits and wine licenses issued by the Department

of Alcoholic Beverage Control in the Commonwealth shall not exceed

a number equal to one (1) for every fifty (50) licenses issued by said

Department of Alcoholic Beverage Control for the sale of distilled spirits

and/or wine at retail.

 

      Section 2. This

administrative regulation shall not prohibit the renewal of licenses. The quota

shall be reduced, in conformance with this administrative regulation, as
