Program.

      STATUTORY AUTHORITY: KRS 194A.050(1)

      NECESSITY, FUNCTION, AND CONFORMITY: KRS 194A.050(1) requires the Secretary of the

Cabinet for Families and Children to promulgate administrative regulations

necessary to operate programs and fulfill responsibilities vested in the

Cabinet for Health and Family Services. This administrative regulation establishes

standards for the Family Preservation Program. It places in topical form the

intensive home-based services, to the extent funds are available, designed to

prevent the imminent removal of a child from his home or to promote the return

of a child to his home.

 

      Section 1. Definitions. (1)

"Cabinet" is defined at KRS 200.010.

      (2) "Family Preservation

Program" or "FPP" means a family preservation services program

as described at KRS 200.575 and 200.585.

 

      Section 2. Eligibility and Referral. (1)

A child referred to the FPP shall meet criteria pursuant to KRS 200.590(1).

      (2) A child shall be referred to the FPP

by:

      (a) Cabinet staff; or

      (b) A regional interagency council pursuant

to KRS 200.509(3).

      (3) The child referred to FPP shall have

at least one (1) parent willing to work with the FPP.

      (4) The family of the child referred to

FPP shall agree to referral to the FPP.

      (5) The safety of the child shall be

maintained, in accordance with KRS 200.575(3) and 200.590(3).

      (6) The FPP shall be offered to a family

only if the cabinet determines that it would be more effective than other

existing programs or resources.

      (7) An emergency custody removal of a

child shall not prohibit a referral for FPP.

 

      Section 3. Family Preservation Services.

The FPP shall:

      (1) Initiate contact with the family

within twenty-four (24) hours of referral;

      (2) If space is available in the FPP

within seventy-two (72) hours of referral:

      (a) Complete an assessment of the family

situation and the program’s ability to maintain family safety and permanency;

and

      (b) Confirm that the family is willing to

participate;

      (3) If the FPP determines that the family

is eligible and out-of-home placement may be safely prevented, accept the

referral and initiate FPP service;

      (4) Make every effort to stabilize the

family;

      (5) Develop goals with the family;

      (6) Teach necessary skills to the family;

      (7) Encourage necessary familial change

in order to alleviate the need for out-of-home placement during the crisis;

      (8) Expend funds, to the extent

available, to enhance the success of the intervention;

      (9) Link a family to other available

community resources as needed to assist that family to maintain the child

safely in the home;

      (10) Provide intensive services, at least

weekly, to assist the family to maintain the child safely in the home; and

      (11) Conduct follow-up contact with the

family at three (3), six (6), and twelve (12) month intervals after termination

of FPP service, in order to assess the safety of the child and the family. (27
