The Department of Agriculture, in exercise of the powers conferred on it by Articles 24(1) and 60(1) of the Diseases of Animals (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Diseases of Animals (Importation of Bird Products) Order (Northern Ireland) 1996 and shall come into operation on 29th March 1996.

Interpretation

2.  In this Order—

“bird” means any bird;

“bird product” means anything originating or made (whether in whole or in part) from living or dead birds and includes the carcase or any part of the carcase of a bird;

“general licence” means a licence granted under Article 3(1) which applies in relation to all persons, or any class of persons who bring or cause to be brought into Northern Ireland from a country outside Northern Ireland any bird product other than a bird product referred to in Article 4;

“specific licence” means a licence granted under Article 3(1) which only applies to the applicant therefor.

Importation of bird products

3.—(1) Subject to Article 4, a person shall not bring or cause to be brought into Northern Ireland from a country outside Northern Ireland any bird product except under and in accordance with the conditions of a licence granted by the Department.

(2) A licence granted under paragraph (1) may be either a general licence or a specific licence.

(3) A general licence shall be granted by the Department by publication of the provisions thereof in the Belfast Gazette.

(4) An application for a specific licence shall be in writing and shall contain such particulars as the Department may require.

(5) The Department may vary, revoke or suspend any licence granted under paragraph (1)—

(a)in the case of a general licence, by a notice published in the Belfast Gazette;

(b)in the case of a specific licence, by a notice in writing sent to the person to whom it was granted.

(6) The Department may vary, revoke or suspend a general licence insofar as it applies to any particular person by notice in writing sent to that person.

4.  This Order shall not apply to bird products which are subject to any of the statutory provisions listed in the Schedule.

Explanatory Note

(This note is not part of the Order.)

This Order prohibits the importation into Northern Ireland of bird products, other than those products subject to the statutory provisions listed in the Schedule, except under and in accordance with the conditions of a licence granted by the Department of Agriculture. Such licences may be—
(a)general, that is applying to any person importing bird products; or
(b)specific, that is only applying to the applicant therefor.
Provision is also made for the revocation, variation and suspension of licences.
