The Department of Agriculture, in exercise of the powers conferred on it by Articles 2(3), 5(1), 19(b), (e), (f), (i) and (k), 29(1) and (2), 32, 44, 46(7A) and 60(1) of the Diseases of Animals (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Specified Bovine Material (Amendment) Order (Northern Ireland) 1996 and shall come into operation on 7th May 1996.

Amendment of the Specified Bovine Material Order (Northern Ireland) 1996

2.  The Specified Bovine Material Order (Northern Ireland) 1996(2) shall be amended as provided in Articles 3 to 5.

3.—(1) In Article 2(1) (Interpretation)—

(a)after the definition of “intestines” there shall be inserted the following definition—

““livestock” means any creature kept for the production of food, wool, skin or fur or for use in the farming of land;”;

(b)for the definition of “mammalian meat and bone meal” there shall be substituted the following definition—

““mammalian meat and bone meal” means proteinaceous material derived from the whole or part of any dead mammal, by a process involving crushing, cooking or grinding, but does not include processed blood;”;

(c)after the definition of “rendering plant” there shall be inserted the following definition—

““scheme animal” means a bovine animal which has been slaughtered pursuant to the purchase, slaughter and disposal scheme introduced under Commission Regulation (EC) No. 716/96(3) adopting exceptional support measures for the beef market in the United Kingdom;”;

(d)for the definition of “specified bovine material” there shall be substituted the following definition—

““specified bovine material” means—

(a)
subject to paragraph (d) of this definition, the head (including the brain but excluding the tongue), spinal cord, spleen, thymus, tonsils and intestines of a bovine animal six months old or over which has died in the United Kingdom or has been slaughtered there;

(b)
the thymus and intestines of a bovine animal two months old or over but less than six months old which has died in the United Kingdom or has been slaughtered there;

(c)
the thymus and intestines of a bovine animal under two months old which has been slaughtered in the United Kingdom for human consumption; and

(d)
subject to paragraph (3), the head (including the brain and the tongue), spinal cord, spleen, thymus, tonsils and intestines of a scheme animal,

and includes anything left attached to such material after dissection of the carcase and any animal matter which comes into contact with the material after it has been removed from the carcase but does not include a whole carcase;”.

(2) After Article 2(2) there shall be added the following paragraphs—

“(3) The provisions of Articles 4(3), 8, 9(1)(e) and 12 shall not apply to specified bovine material from scheme animals.

(4) The provisions of paragraph 1 of Part I of the Schedule shall apply to specified bovine material from scheme animals subject to the modification that specified bovine material need not be stored, handled and processed separately from animal material from scheme animals.”.

Prohibition on sale, supply and use of certain feedingstuffs for feeding to animals and poultry

4.  In Article 4(1) (Prohibition on sale, supply and use of certain feedingstuffs for feeding to animals and poultry) in sub-paragraphs (g) and (h) for the words “poultry or animals” there shall be substituted “livestock, fish or equine animals”.

Rendering plants

5.  In Article 6 (Rendering plants) after paragraph (11) there shall be added the following paragraphs—

“(12) The provisions of paragraph (5) shall not apply in the case of any animal material from a scheme animal.

(13) The provisions of paragraph (7) shall not apply to any equipment used for the processing of any part of a scheme animal.”.

Explanatory Note

(This note is not part of the Order.)
This Order amends the Specified Bovine Material Order (Northern Ireland) 1996. The Order makes the following principal changes—
1.  The definition of “mammalian meat and bone meal” does not include processed blood.

2.  The definition of “specified bovine material” has been amended to include specified parts of the carcase of a scheme animal, that is to say a bovine animal which has been slaughtered pursuant to the purchase, slaughter and disposal scheme introduced under Commission Regulation (EC) No. 716/96 adopting exceptional support measures for the beef market in the United Kingdom.

3.  The prohibition on the sale, supply or feeding to poultry or animals of feedingstuffs in which mammalian meat and bone meal has been incorporated now applies to livestock, fish or equine animals.

4.  In a rendering plant—

(a)specified bovine material may come into contact with any animal material from a scheme animal;

(b)equipment used for processing specified bovine material may be used for processing any part of a scheme animal; and

(c)specified bovine material need not be stored, handled and processed separately from animal material from a scheme animal.
