The Animals (Scientific Procedures) Act 1986 (Fees) (No. 2) Order 1996

In exercise of the powers conferred upon him by section 8 of the Animals (Scientific Procedures) Act 1986(1), The Secretary of State hereby makes the following Order:

1.—(1) This Order may be cited as the Animals (Scientific Procedures) Act 1986 (Fees) (No. 2) Order 1996 and shall come into force on 1st January 1997.

(2) This Order does not extend to Northern Ireland.

(3) In this Order “the Act” means the Animals (Scientific Procedures) Act 1986.

(4) The Animals (Scientific Procedures) Act (Fees) Order 1993(2) is hereby revoked.

2.  For the period 1st January to 31st March 1997 the following provisions shall apply:

(a)The fee payable by the holder of a certificate issued under section 6 of the Act (scientific procedures establishments), in respect of any period between 1st January and 31st March 1997 during which the certificate is in force, shall be £98.

(b)The fee payable by the holder of a certificate issued under section 7 of the Act (breeding and supplying establishments), in respect of any period between 1st January and 31st March 1997 during which the certificate is in force shall be £445.

(c)In addition the fee payable in respect of any period between 1st January to 31st March 1997 during which a certificate mentioned in paragraph (a) or (b) above is in force, shall be £89 for each person who holds—

(i)a personal licence which specifies the establishment to which the certificate relates as the place where the licence is primarily available, or

(ii)a licence which is treated as a personal licence under paragraph 1 of Schedule 4 to the Act and which names the establishment to which the certificate relates as the only or first-named place where the person is authorised to perform experiments.

3.  From 1st April 1997, for the period of twelve months ending with 31st March the following year (“the financial year”), and each subsequent financial year, the following provisions shall apply:

(a)The fee payable by the holder of a certificate issued under section 6 of the Act (scientific procedures establishments) in respect of the financial year during the whole or part of which the certificate is in force shall be £150.

(b)The fee payable by the holder of a certificate issued under section 7 of the Act (breeding and supplying establishments) in respect of the financial year during the whole or part of which the certificate is in force shall be £675.

(c)In addition the fee payable in respect of the financial year during the whole or part of which a certificate mentioned in paragraph (a) or (b) above is in force, shall be £135 for each person who holds—

(i)a personal licence which specifies the establishment to which the certificate relates as the place where the licence is primarily available, or

(ii)a licence which is treated as a personal licence under paragraph 1 of Schedule 4 to the Act and which names the establishment to which the certificate relates as the only or first-named place where the person is authorised to perform experiments.

Explanatory Note

(This note is not part of the Order)
This Order, which does not extend to Northern Ireland, prescribes the fees payable by the holder of certificates under section 6 of the Animal (Scientific Procedures) Act 1986 (scientific procedure establishments) and under section 7 of the Act (breeding and supplying establishments).
For the period 1st January 1997 to 31st March 1997 the fee for scientific procedure establishments is made up of £98 plus £89 for each personal licensee whose place of primary availability is the establishment in question. For a breeding and supplying establishment which is not also a scientific procedure establishment the fee is £445.
From 1st April 1997 to 31st March 1998, and each financial year thereafter, the fee for scientific procedure establishments is made up of £150 plus £135 for each personal licensee whose place of primary availability is the establishment in question. For a breeding and supplying establishment which is not also a scientific procedure establishment the fee is £675. This changes the fee period from a calendar year to a financial year and increases the annual fee payable by a breeding and supplying establishment by £28, for a personal licence by £25 and by a breeding and supplying establishment which is not also a scientific procedure establishment by £123.
