The Disability Discrimination Act 1995 (Commencement No. 2) Order (Northern Ireland) 1996

The Department of Health and Social Services, in exercise of the powers conferred on it by section 70(3) of the Disability Discrimination Act 1995(1) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Disability Discrimination Act 1995 (Commencement No. 2) Order (Northern Ireland) 1996.

Appointed day

2.  The day appointed for the coming into operation of the provisions of the Disability Discrimination Act 1995 specified in Article 3 is 30th May 1996.

Provisions commenced

3.  The provisions referred to in Article 2 are—

(a)section 1 (Meaning of “disability” and “disabled person”);

(b)section 2 (Past disabilities);

(c)section 3(2) (Guidance);

(d)section 16(3) in so far as it relates to the definitions of “sub-lease” and “sub-tenancy”, and (5) in so far as it relates to paragraph 4(3) of Schedule 4 (Sub-leases etc.);

(e)section 28(4) (Provision of advice and assistance);

(f)section 59(5) (Statutory authority and national security);

(g)section 62(1), (2) and (7)(6) (Restriction of publicity: industrial tribunals);

(h)section 67(7) (Regulations and orders);

(i)section 68(1)(8) (Interpretation);

(j)section 69 (Financial provisions);

(k)section 70(7) (House of Commons and Northern Ireland Assembly disqualification);

(l)Schedule 1 (with the exception of paragraph 7) (Provisions Supplementing Section 1);

(m)Schedule 2 (Past Disabilities);

(n)Schedule 4, paragraph 4 (Sub-leases etc.).

Explanatory Note

(This note is not part of the Order.)
This Order appoints 30th May 1996 as the day for the coming into operation of certain provisions of, as modified in its application to Northern Ireland by Schedule 8 to, the Disability Discrimination Act 1995 relating to the definition of disability; past disabilities; guidance; definition of lease, sub-lease and sub-tenancy; advice and assistance; statutory authority and national security; restriction of publicity in industrial tribunals; regulations and orders; interpretation; financial provisions; House of Commons and Northern Ireland Assembly disqualification; provisions supplementing the definition of disability and past disabilities.
