The Secretary of State, being a Minister designated(1) for the purpose of section 2(2) of the European Communities Act 1972(2) in relation to the regulation of specifications, construction, placing on the market and use of equipment intended for weighing, measuring or testing or for purposes ancillary thereto, in exercise of the powers conferred by that section and, with the consent of the Treasury, in exercise of the powers conferred on him by section 56(1) and (2) of the Finance Act 1973(3), and in exercise of all other powers enabling him in that behalf, hereby makes the following Regulations: —
Citation, commencement and interpretation
1.—(1) These Regulations may be cited as the Measuring Instruments (EEC Requirements) (Gas Volume Meters) (Amendment) Regulations 1996 and shall come into force on 11th March 1996.
(2) In these Regulations, “the 1988 Regulations” means the Measuring Instruments (EEC Requirements) Regulations 1988(4) as applied to gas volume meters by the Measuring Instruments (EEC Requirements) (Gas Volume Meters) Regulations 1988.(5)
Amendment of the 1988 Regulations
2. In their application to Great Britain, the 1988 Regulations shall have effect on and after the day on which these Regulations come into operation with the substitution, for each reference to the Secretary of State, of a reference to the Director General of Gas Supply (hereinafter, “the Director”).
Power of Director to charge fees
3. The Director may charge such reasonable fees as he may determine in respect of any costs reasonably incurred by him for the purpose of —
(i)an examination of any pattern of instrument submitted to him in accordance with regulation 8 of the 1988 Regulations (EEC pattern approval);
(ii)considering such an application as is mentioned in regulation 13 of the 1988 Regulations (EEC initial verification); and
(iii)re-examining meters bearing the mark of EEC initial verification under regulation 4 of the Gas (Meters) Regulations 1983.(6)

4. The Measuring Instruments (EEC Requirements) (Gas Volume Meters) (Fees) Regulations 1983(7) are hereby revoked.

The Measuring Instruments (EEC Requirements) (Gas Volume Meters) Regulations 1988 applied the Measuring Instruments (EEC Requirements) Regulations 1988, subject to modifications, to certain gas volume meters to which Council Directive No. 71/318/EEC, as amended, applied and implemented the obligations of the United Kingdom under that Directive and under Council Directive 1971/316/EEC, as amended. The effect was to confer functions on the Secretary of State in relation to EEC pattern approval and initial verification of such meters.
The present Regulations transfer these functions to the Director General of Gas Supply in relation to Great Britain (Northern Ireland being unaffected).
The Regulations also confer on the Director General power to charge fees in respect of the costs incurred by him for the purpose of carrying out the functions so transferred. In consequence, the Measuring Instruments (EEC Requirements) (Gas Volume Meters) (Fees) Regulations 1983, which set out the fees formerly chargeable by the Secretary of State in respect of these matters, are revoked.
