The Secretary of State for Transport, (as respects England) and the Secretary of State for Wales, (as respects Wales) in exercise of the powers conferred by section 17(2) and (3) of the Road Traffic Regulation Act 1984(1) (“the 1984 Act”) and of all other powers enabling them in that behalf and after consultation with representative organisations in accordance with section 134(2) of the 1984 Act, hereby make the following Regulations:

Citation and Commencement

1.  These Regulations may be cited as the Motorways Traffic (England and Wales) (Amendment) Regulations 1995 and shall come into force on 1st January 1996.

Amendments to Regulation 12

2.—(1) Regulation 12 of the Motorways Traffic (England and Wales) Regulations 1982(2) shall be amended as follows.

(2) In paragraph (1), for sub–paragraph (b) there shall be substituted the following sub–paragraph—

“(b)a passenger vehicle which is constructed or adapted to carry more than eight seated passengers in addition to the driver the maximum laden weight of which exceeds 7.5 tonnes;”.

(3) For paragraph (5) there shall be substituted the following paragraph—

“(5) In this Regulation “goods vehicle”, “passenger vehicle” and “maximum laden weight” have the same meanings as in Schedule 6 to the 1984 Act.”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations further amend the Motorways Traffic (England and Wales) Regulations 1982.
Regulation 12 of the 1982 Regulations prohibits certain classes of vehicle from using the outside lane of motorways where a carriageway has three or more lanes. Regulation 12(1)(b) is substituted so that passenger vehicles which are constructed or adapted to carry eight or more seated persons in addition to the driver and that have a maximum laden weight that exceeds 7.5 tonnes, shall be prohibited vehicles for the purpose of that regulation.
