The Mental Health (State Hospital Management Committee, State Hospital, Carstairs) (Scotland) Transfer and Dissolution Order 1995

The Secretary of State in exercise of the powers conferred on him by section 91(3) of the Mental Health (Scotland) Act 1984(1) and of all other powers enabling him in that behalf hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Mental Health (State Hospital Management Committee, State Hospital, Carstairs) (Scotland) Transfer and Dissolution Order 1995 and shall come into force on 1st April 1995.

Transfer

2.—(1) The property, rights and liabilities of the State Hospital Management Committee, which Committee was constituted by the Mental Health (State Hospital Management Committee, State Hospital, Carstairs) (Scotland) Order 1984(2), shall on 1st April 1995 transfer and be vested in the State Hospitals Board for Scotland constituted by the State Hospitals Board for Scotland Order 1995(3).

(2) Such transfer shall be a relevant transfer for the purposes of the Transfer of Undertakings (Protection of Employment) Regulations 1981(4).

Dissolution

3.  The said State Hospital Management Committee is hereby dissolved.

Explanatory Note

(This note is not part of the Order)
This Order provides for the transfer on 1st April 1995 of property rights and liabilities of the State Hospital Management Committee, Carstairs to the State Hospitals Board for Scotland. The transfer is to be a relevant transfer for the purposes of the Transfer of Undertakings (Protection of Employment) Regulations 1981. It also provides for the dissolution of the State Hospital Management Committee.
