ROAD TRAFFIC
The Road Traffic (Special Parking Area) (London Borough of Sutton) (Amendment) Order 1995

Whereas the council of the London borough of Sutton has applied to the Secretary of State for an order to be made under section 76 of the Road Traffic Act 1991(1), and the Secretary of State has consulted the Commissioner of Police of the Metropolis in accordance with section 76(2) of that Act:

NOW, the Secretary of State for Transport, in exercise of the powers conferred by section 76(1) and section 77(6) of the Road Traffic Act 1991 and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Road Traffic (Special Parking Area) (London Borough of Sutton) (Amendment) Order 1995 and shall come into force on 31st March 1995.

Interpretation

2.  In this Order—

“the 1984 Act” means the Road Traffic Regulation Act 1984(2);

“the 1991 Act” means the Road Traffic Act 1991;

“the excluded areas” means the areas in the London borough of Sutton referred to in the Schedule to this Order; and

“the principal order” means the Road Traffic (Special Parking Area) (London Borough of Sutton) Order 1994(3).

Exclusions from special parking area

3.—(1) The excluded areas shall cease to form part of the special parking area designated by article 3(1) of the principal order.

(2) The modifications of the 1984 and 1991 Acts contained in articles 4 and 5 of the principal order shall cease to have effect in relation to the excluded areas.

SCHEDULEAREAS IN THE LONDON BOROUGH OF SUTTON CEASING TO FORM PART OF THE SPECIAL PARKING AREA

The areas to be transferred from the London borough of Sutton to the county of Surrey and the district of Epsom and referred to in article 6(1) of the Greater London and Surrey (County and London Borough Boundaries) Order 1994(4).
Explanatory Note

(This note is not part of the Order)
This Order amends the Road Traffic (Special Parking Area) (London Borough of Sutton) Order 1994 (“the principal order”) by excluding from the special parking area designated by that order certain areas which are to be transferred to the county of Surrey in accordance with local government boundary changes. The consequential modifications made by the principal order to the Road Traffic Regulation Act 1984 and the Road Traffic Act 1991 cease to apply to the excluded areas.
