The Secretary of State, in exercise of the powers conferred on him by section 12A(1) of and paragraphs 1 and 3(1)(b) of Schedule 7A to the National Health Service (Scotland) Act 1978(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Royal Infirmary of Edinburgh National Health Service Trust (Establishment) Amendment Order 1995 and shall come into force on 31st March 1995.

(2) In this Order “the principal Order” means the Royal Infirmary of Edinburgh National Health Service Trust (Establishment) Order 1993(2).

Amendment of Article 3 of the principal Order

2.  For article 3 of the principal Order there shall be substituted the following:—

“3.—(1) The trust is established for the purposes specified in section 12A(1) of the Act(3).

(2) The trust’s functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the trust for one or more health boards) shall be—

(a)to own and manage under section 12A(1)(a) of the Act the hospital establishments or facilities known as the Royal Infirmary of Edinburgh, Pricess Margaret Rose Orthopaedic Hospital, City Hospital, Edinburgh Dental Hospital, Simpson Memorial Maternity Pavilion, Princess Alexandra Eye Pavilion and Chalmers Hospital, all in Edinburgh, and establishments associated with those hospitals, including management of the facilities provided at and from those establishments, and also including the management of the teaching and research facilities associated with these establishments and the support services related thereto; and

(b)to provide and manage under section 12A(1)(b) of the Act a new hospital and associated facilities to replace the Royal Infirmary of Edinburgh.”.

Explanatory Note

(This note is not part of the Order)
This Order substitutes a new article 3 in the Royal Infirmary of Edinburgh National Health Service Trust (Establishment) Order 1993 to empower the trust to build a new hospital to replace the Royal Infirmary of Edinburgh.
