The Secretary of State for Transport as respects England and the Secretary of State for Wales as respects Wales in exercise of their powers under sections 53(1), (2), (3) and (6) and 104(1) of the New Roads and Street Works Act 1991(1) and of all other powers enabling them in that behalf, hereby make the following regulations:—

Citation and Commencement

1.  These Regulations may be cited as the Street Works (Registers, Notices, Directions and Designations) (Amendment) Regulations 1995 and shall come into force on 1st July 1995.

Interpretation

2.  In these Regulations “the Principal Regulations” shall mean the Street Works (Registers, Notices, Directions and Designations) Regulations 1992(2).

Revocation

3.  Regulation 3(1) of the Principal Regulations is hereby revoked.

Street Works Registers

4.  In place of regulation 3(1) of the Principal Regulations there shall be inserted the following:

“Registers shall be kept so as to enable the information referred to in paragraphs (2) and (3) relating to a particular street to be traced and shall be indexed and be in a form which complies with the system of street referencing specified in Part I of the publication issued by the British Standards Institution on the 15th June 1993 entitled “Spatial data— sets for geographic referencing” under reference No BS 7666, provided that there shall be unique street identifier numbers using the street number ranges which have been allocated to each street naming authority in list B1 of Annex B to the said publication and provided that where the street is maintainable at public expense the highway authority shall be identified.”

5.  In the table which appears below regulation 3(2) of the Principal Regulations the words “The undertaker concerned” shall be substituted for “the highway authority” in the second column against the first entry in the table.

Explanatory Note

(This note is not part of the Regulations)

1.  Regulation 4 has the effect of placing a new requirement on street authorities with regard to the form in which they are to keep street works registers as required by section 53 of the New Roads and Street Works Act 1991. Previously, a street works register could be kept in any form, but under new regulation 3(1) of the Street Works (Registers, Notices, Directions and Designations) Regulations 1992 (“the Principal Regulations”) they must be kept in compliance with Part I of the British Standards Institution (BSI) publication entitled “Spatial data— sets for geographic referencing” (BS 7666). Copies of this publication can be obtained from the BSI, Linford Wood, Milton Keynes MK14 6LE and also from HMSO bookshops.

2.  Regulation 5 amends the table below regulation 3(2) of the Principal Regulations and makes the relevant undertaker responsible for securing the registration of certain information in place of the highway authority.
