Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 7) Order 2011

The Department of Justice makes the following Order, in exercise of the powers conferred by Article 1(4) of the Criminal Justice (Northern Ireland) Order 2008 (1) and now vested in it (2).

Citation

1.  This Order may be cited as the Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 7) Order 2011.

Commencement

2.  The following provisions of the Criminal Justice (Northern Ireland) Order 2008 shall come into operation on the 1st January 2012—

(a)Article 45 (supervised activity order for default in payment of certain fines); and

(b)Schedule 3 (supervised activity orders: further provisions).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation Article 45 of and Schedule 3 to the Criminal Justice (Northern Ireland) Order 2008 on 1st January 2012. These provisions provide the court with the power to make a Supervised Activity Order (SAO) as an alternative to committal to custody for fine default.

Article 4(1) of and paragraph 32 of Schedule 1 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010/976) transferred the functions of the Secretary of State under Article 1(4) of the Criminal Justice (Northern Ireland) Order 2008 to the Department of Justice in Northern Ireland.
