Whereas a draft of this Order has been laid before Parliament and has been approved by a resolution of each House of Parliament in accordance with section 1(4) of the Hovercraft Act 1968(1);

Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 1(1)(h) and (3) of the said Act(2) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1.  This Order may be cited as the Hovercraft (Application of Enactments) (Amendment) Order 1995 and shall come into force forthwith.

2.—(1) The Hovercraft (Application of Enactments) Order 1972(3) shall be amended as follows.

(2) Article 7 shall be omitted.

(3) In article 8—

(a)in sub-paragraph (a) of paragraph (1), for “544 to 571” there shall be substituted “551 to 571”;

(b)sub-paragraph (c) of the said paragraph shall be omitted;

(c)for sub-paragraphs (f) and (g) of the said paragraph there shall be substituted the following sub-paragraphs—

“(f)The Merchant Shipping (Navigational Warnings) Regulations 1980(4);

(g)The Merchant Shipping (Signals of Distress) Rules 1992(5);”

(d)paragraph (3) shall be omitted.

Explanatory Note

(This note is not part of the Order)
This Order further amends the Hovercraft (Application of Enactments) Order 1972.
Article 2(2) revokes article 7 of the 1972 Order in consequence of superseding provision contained in the Insurance Companies Act 1982 (c. 50).
Article 2(3) amends article 8 of the 1972 Order (which applies to hovercraft certain enactments and instruments relating to, among other things, the salvage of ships). The amendments in article 2(3)(a), (b) and (d) are consequential on the Merchant Shipping (Salvage and Pollution) Act 1994 (c. 28), section 1 and Schedule 1; which since 1st January 1995 (their coming into force date) have made new provision in respect of the salvage of ships, craft, structures capable of navigation, and other property.
The amendments in article 2(3)(c) replace references to two instruments which have been revoked with references to the instruments which have replaced them.
