The Secretary of State, in exercise of the powers conferred on him by sections 12A, 12B, 12C and 143(1) of the Roads (Scotland) Act 1984(1) and of all other powers enabling him in that behalf, having considered it necessary or expedient as a result of, or in connection with, the establishment of new local government areas on 1st April 1996, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Roads (Transitional Powers) (Scotland) Order 1995 and shall come into force on 1st April 1996.

Interpretation

2.  In this Order—

“the 1984 Act” means the Roads (Scotland) Act 1984;

“classification” means the identification of a road by reference to a letter and number combination at the date of making of this Order;

“list of public roads” shall have the meaning ascribed to that expression in section 1(1) of the 1984 Act;

“slip road” means as the case may be—

(a)
a road which provides access to or from a special road and which is restricted to traffic authorised to use that special road; or

(b)
a road which provides access to or from a road and which has the same classification as that road; and

“specified date” means 1st April 1996.

Existing Roads

3.—(1) It is directed that as from the specified date the roads listed in Part I of Schedule 1 to this Order shall become trunk roads and the roads listed in Part II of that Schedule shall cease to be trunk roads.

(2) In respect of any road ceasing to be a trunk road in terms of paragraph (1) above it is directed that as from the specified date the local roads authority(2) for the area listed opposite the road in question in Part II of Schedule 1 shall become the roads authority for that road and on that date shall enter that road in their list of public roads.

Proposed Roads

4.—(1) It is directed that as from the specified date the proposed roads listed in Part I of Schedule 2 to this Order shall become trunk roads and the proposed roads listed in Part II of that Schedule shall not become trunk roads.

(2) In respect of any proposed road which in terms of paragraph (1) above is not to become a trunk road it is directed that as from the specified date the local roads authority for the area listed opposite the proposed road in question in Part II of Schedule 2 shall become the roads authority for that proposed road and shall enter that road in their list of public roads on the date when the proposed road is open for through traffic.

(3) This article applies to proposed roads falling within the definition of that expression contained in section 151(1) of the 1984 Act on the date of the making of this Order.

Special Road Schemes

5.  It is directed that as from the specified date the Secretary of State is authorised to provide the special roads referred to in the schemes listed in Schedule 3 to this Order.

SCHEDULE 1

PART Iroads to become trunk roads

1.  The A895 Latheron-Georgemas Road from its junction with the M9/A9/A882 Edinburgh-Thurso Trunk Road at Latheron to its junction with the M9/A9/A882 Edinburgh-Thurso Trunk Road at Roadside.

2.  That length of the A82 between the Longman Roundabout and Glenurquhart Road (within the former Inverness Burgh) from its junction with the M9/A9/A882 Edinburgh-Thurso Trunk Road at Longman Roundabout to the former Inverness Burgh Boundary at its connection with the A82 Glasgow-Inverness Trunk Road at Tomnahurich Bridge.

3.  That length of the A95 Granish-Kinveachy-Grantown on Spey-Keith-Banff Road from its junction with the M9/A9/A882 Edinburgh-Thurso Trunk Road at Granish, Aviemore to its junction with the proposed Grantown on Spey Bypass at the access road leading to Upper Craggan, Grantown on Spey.

4.  That length of the A95 Granish-Kinveachy-Grantown on Spey-Keith-Banff Road from its junction with the proposed Grantown on Spey Bypass north of Spey Bridge to its junction with the A96 Aberdeen-Inverness Trunk Road at Keith.

5.  The Peterhead Peripheral Road from its junction with the A956/A92/A952 Aberdeen-Fraserburgh Trunk Road at Invernettie Roundabout to its junction with the A956/A92/A952 Aberdeen-Fraserburgh Trunk Road at Waterside, South of Inverugie.

6.  That length of the A90/A92/A96 Perth-Aberdeen-Inverness Road from its connection with the A90 Inverkeithing-Aberdeen Trunk Road at South Damhead to The Bridge of Dee, Aberdeen.

7.  That length of the A90/A92/A96 Perth-Aberdeen-Inverness Road from The Bridge of Dee to the junction of the A92/A96 at North Anderson Drive/Great Northern Road, Aberdeen.

8.  That length of the A92 within Aberdeen comprising part of Muggiemoss Road and The Parkway from the junction of the A92/A96 at North Anderson Drive/Great Northern Road to its junction with the A956/A92/A952 Aberdeen-Fraserburgh Trunk Road at Ellon Road.

9.  That length of the A90/A92/A96 Perth-Aberdeen-Inverness Road within Aberdeen from the junction of the A92/A96 at North Anderson Drive/Great Northern Road to its junction with Manor Drive at its connection with the A96 Aberdeen-Inverness Trunk Road.

10.  That length of the A850 Kyleakin-Broadford-Portree-Dunvegan Castle Road from its junction with the A87 Invergarry-Kyle of Lochalsh Trunk Road Extension, Skye Bridge Crossing Special Road at Kyleakin to its junction with the A856 Borve-Uig-Uig Pier Road at Borve.

11.  The A856 Borve-Uig-Uig Pier Road from its junction with the A850 Kyleakin-Broadford-Portree-Dunvegan Castle Road to Uig Pier.

12.  The A887 Invermoriston-Glenmoriston-Moriston Bridge Road from its junction with the A82 Glasgow-Inverness Trunk Road at Invermoriston to its junction with the A87 Invergarry-Kyle of Lochalsh Trunk Road at Moriston Bridge.

13.  The A86 Spean Bridge-Newtonmore-Kingussie-Kerrow Road from its junction with the A82 Glasgow-Inverness Trunk Road at Spean Bridge to its junction with the M9/A9/A882 Edinburgh-Thurso Trunk Road near Kingussie.

14.  The A889 Dalwhinnie-Laggan Bridge Road from its junction with the M9/A9/A882 Edinburgh-Thurso Trunk Road at Dalwhinnie to its junction with the A86 Spean Bridge-Newtonmore-Kingussie-Kerrow Road at Laggan Bridge.

15.  The A819 Inveraray-A85 Tyndrum-Oban Trunk Road from its junction with the A83 Tarbet-Lochgilphead Trunk Road at Inveraray to its junction with the A85 Tyndrum-Oban Trunk Road west of Dalmally.

16.  That length of the A83 Tarbet-Campbeltown Road from its connection with the A83 Tarbet-Lochgilphead Trunk Road at Corran Roundabout, Lochgilphead to its junction with the access road to Kennacraig Ferry Terminal.

17.  That length of the A85 Perth-Crieff-Lochearnhead Road from its junction with the slip roads on the M9/A9/A882 Edinburgh-Thurso Trunk Road at the Perth Western Bypass to its junction with the A84/A85 Stirling-Crianlarich Trunk Road at Lochearnhead.

18.  That length of the A914 Melville Gates-Letham Toll-Rathillet-A92 by Forgan School Road from its junction with the A91 Arlary to St Andrews Trunk Road at Melville Gates to its junction with the A92 New Inn-Cupar-Balmullo-A914 by Forgan School-Tay Bridge Roundabout Road at Forgan Roundabout.

19.  That length of the A92 New Inn-Cupar-Balmullo-A914 by Forgan School-Tay Bridge Roundabout Road from its junction with the A914 Melville Gates-Letham Toll-Rathillet-A92 by Forgan School Road at Forgan Roundabout to the Tay Bridge Roundabout south of the Tay Bridge.

20.  That length of the A991 North, East, South and West Marketgait (Dundee Inner Ring Road) from its junction with the slip roads leading to and from the Tay Bridge to its junction with the A92 Dundee-Arbroath-Montrose-Stonehaven Road at the junction of South Marketgait/East Dock Street, Dundee.

21.  That length of the A92 Dundee-Arbroath-Montrose-Stonehaven Road from its junction with the A991 North, East, South and West Marketgait (Dundee Inner Ring Road) at South Marketgait/East Dock Street, Dundee to its roundabout junction with the A972 Kingsway East, Dundee at Arbroath Road, Dundee.

22.  That length of the A972 Kingsway East, Dundee from its roundabout junction with the M90/A90 Inverkeithing-Aberdeen Trunk Road at Forfar Road, Dundee to its roundabout junction with the A92 Dundee-Arbroath-Montrose-Stonehaven Road at Arbroath Road, Dundee.

23.  The M8 motorway through Glasgow, together with all slip roads, from its connection with the A8/M8/A8 Edinburgh-Glasgow Trunk Road at Baillieston Interchange to its connection with the M8/A8 Glasgow-Port Glasgow Trunk Road at Hillington Interchange.

24.  That length of the M80 motorway within Glasgow, together with all slip roads, from its connection with the M80/A80/M80 Glasgow-Stirling Trunk Road at Millerston (Glasgow City Boundary) to its junction with the M8 motorway (Junction 13).

25.  The M77 motorway within Glasgow, together with all slip roads, from its junction with the M8 motorway through Glasgow (Junction 22) to its junction with the B768 at Dumbreck Road, Glasgow.

26.  That length of the A725 Coatbridge-East Kilbride Road, together with all slip roads, from its junction with the eastbound slip roads on the A8/M8/A8 Edinburgh-Glasgow Trunk Road at Coatbridge to its junction with the A726 Strathaven-East Kilbride-Paisley Road at Queensway Roundabout, East Kilbride.

27.  That length of the A726 Strathaven-East Kilbride-Paisley Road from its junction with the A725 Coatbridge-East Kilbride Road at Queensway Roundabout, East Kilbride to its junction with the B766.

28.  That length of the A737 St James Interchange-Kilwinning-Irvine Road, together with all slip roads, from its junction with the M8/A8 Glasgow-Port Glasgow Trunk Road at St James Interchange to its junction with the A738 Stevenston-Kilwinning Road at Kilwinning.

29.  That length of the A738 Stevenston-Kilwinning Road from its junction with the A737 St James Interchange-Kilwinning-Irvine Road at Kilwinning to its junction with the A78 Greenock-Prestwick Trunk Road at Hawkhill.

30.  That length of the A8 Port Glasgow-Greenock Road within the former Burgh of Greenock from the former Burgh Boundary at its connection with the M8/A8 Glasgow-Port Glasgow Trunk Road to its junction with the A78/A770 at Bullring Roundabout.

33.  That length of the A720 Edinburgh City Bypass, together with all slip roads, from its junction with the A1 Edinburgh-Berwick upon Tweed Trunk Road at Old Craighall Junction to its junction with the proposed M8 extension north west of Sighthill.

34.  That length of the A6091 Galashiels-Newtown St Boswells Road from its junction with the A7 Edinburgh-Carlisle Trunk Road at Kingsknowe Roundabout by Galafoot Bridge to the Melrose Junction near Wairds Cemetery.

35.  The A751 Inchparks Training Centre to Innermessan Road from its junction with the A75 Gretna-Stranraer Trunk Road at Inchparks Training Centre to its junction with the A77 Glasgow-Stranraer Trunk Road at Innermessan.

SCHEDULE 2

PART Iproposed roads to become trunk roads

1.  The proposed road to be constructed in terms of the Craggan to Riverside Road Scheme promoted by Highland Regional Council and to form the Grantown on Spey Bypass from the junction of the A95 Granish-Kinveachy-Grantown on Spey-Keith-Banff Road with the access road leading to Upper Craggan, Grantown on Spey in a north easterly direction via and including the new roundabout at Cemetery then in an easterly direction to and including the new roundabout to be provided at the proposed junction with the A95 Granish-Kinveachy-Grantown on Spey-Keith-Banff Road north of Spey Bridge.

2.  The proposed road to be constructed in terms of the Melrose to A68 Phase 3 Road Scheme promoted by Borders Regional Council from the Melrose junction on the A6091 Galashiels-Newton St Boswells Road near Wairds Cemetery in a generally easterly direction to the proposed junction with the A68 Edinburgh-Newcastle Upon Tyne Trunk Road at Ravenswood.

PART IIproposed road not be become a trunk road

Article 5

SCHEDULE 3SPECIAL ROADS TO BE PROVIDED BY THE SECRETARY OF STATE

The Special Roads described in—

The Strathclyde Regional Council (Ayr Road Route) (A77) (Dumbreck to City of Glasgow District Boundary) Special Road Scheme 1987, and

The Strathclyde Regional Council (Ayr Road Route) (A77) (Dumbreck to City of Glasgow District Boundary) (Connecting Roads) Special Roads Scheme 1987.

Explanatory Note

(This note is not part of the Order)
This Order provides for the change in status of roads considered necessary or expedient as a result of or in connection with the establishment of new local government areas on 1st April 1996. The Order also makes certain consequential provisions.
Article 3 provides that as from 1st April 1996 certain roads shall become or cease to be trunk roads. These roads are listed in Schedule 1 . For roads which cease to be trunk roads it is provided that the local roads authority shall become responsible for that road.
Article 4 makes similar provision for proposed roads which are in the course of construction or proposed to be built at the date of making the Order. Article 5 makes similar provision for special roads contained within special road schemes. The proposed roads and special roads concerned are listed in Schedules 2 and 3 respectively.
