The Goods Vehicles (Operators' Licences, Qualifications and Fees) (Amendment) Regulations 1995

The Secretary of State for Transport, in exercise of the powers conferred by sections 60(2)(b), 89(1) and 91(1) of the Transport Act 1968(1), and now vested in him(2), and the Department of Transport (Fees) Order 1988(3), and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 91(8) of that Act, hereby makes the following Regulations:—
1. These Regulations may be cited as the Goods Vehicles (Operators' Licences, Qualifications and Fees) (Amendment) Regulations 1995 and shall come into force on 1st July 1995.
2. The Goods Vehicles (Operators' Licences, Qualifications and Fees) Regulations 1984(4) shall be further amended in accordance with the following provisions of these Regulations.
3.—(1) In regulation 3(2)—
(a)in the definition of “keeper”, for the words “the Vehicles (Excise) Act 1971” there shall be substituted “the Vehicle Excise and Registration Act 1994” (5);
(b)in the definition of “recovery vehicle”, for the words “Part I of Schedule 3 to the Vehicles (Excise) Act 1971” there shall be substituted “Part V of Schedule 1 to the Vehicle Excise and Registration Act 1994”;
(c)in the definition of “showman’s goods vehicle”, for the words “Schedule 4 to the Vehicles (Excise) Act 1971” there shall be substituted “section 62(1) of the Vehicle Excise and Registration Act 1994”;
(d)in the definition of “tower wagon”, for the words “section 4(2) of the Vehicles (Excise) Act 1971” there shall be substituted “paragraph 17 of Schedule 2 to the Vehicle Excise and Registration Act 1994 as originally enacted”; and
(e)in the definition of “trade licence” for the words “section 38(1) of the Vehicles (Excise) Act 1971” there shall be substituted “section 62(1) of the Vehicle Excise and Registration Act 1994”.
4. In regulation 35(1A)—
(a)for the words “1st June 1994” there shall be substituted the words “1st July 1995”, and
(b)in sub-paragraph (b) for “£8” there shall be substituted “£8.50”.
5. In regulation 35(1B)—
(a)for the words “1st June 1994” there shall be substituted the words “1st July 1995”, and
(b)in sub-paragraph (a) for “£8” there shall be substituted “£8.50”.
6. In paragraph 1 of Part I of Schedule 5, for the words “paragraph 2 of Part I of Schedule 3 to the Vehicles (Excise) Act 1971” there shall be substituted “paragraph 4(3) of Part IV of Schedule 1 to the Vehicle Excise and Registration Act 1994 as originally enacted”.
7. Nothing in regulation 4 or 5 of these Regulations affects the fee payable in respect of the grant or variation of a licence before 1st July 1995.

Explanatory Note
(This note is not part of the Regulations)
These Regulations further amend the Goods Vehicles (Operators' Licences, Qualifications and Fees) Regulations 1984.
They replace references to, or to the provisions of, the Vehicles (Excise) Act 1971 with references to, or the equivalent provisions of, the Vehicle Excise and Registration Act 1994. Where, on the date on which these Regulations come into force the equivalent provisions of the 1994 Act will be repealed by virtue of amendments made in Schedule 4 to the Finance Act 1995, the substituted references are to the provisions of the 1994 Act as originally enacted.
They make the following amendments as respects fees. The relevant fees were last amended with effect from 1st June 1994 by S.I. 1994/1209.
The fee prescribed in respect of the grant of a goods vehicle operator’s licence on or after 1st July 1995 is increased from £8 to £8.50 in respect of each specified vehicle.
The fee prescribed in respect of a variation of a licence on or after 1st July 1995 is increased from £8 to £8.50 for each additional vehicle where the variation results in an addition to the highest number of specified vehicles between the grant of the licence and the variation.
