Coming into force in accordance with article 1
The Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1995 Partial Revocation Order 1995 and shall come into force at 20.00 hours on 26th June 1995.

Revocation

2.  The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1995(2) is revoked insofar as it designates any part of the area set out in the Schedule to this Order.

Article 2
SCHEDULE
The area of sea off the east coast of Scotland below mean high water springs enclosed by a line extending from a point at 57° 15'N latitude and 002° 02.5'W longitude (Balmedie) in an easterly direction to a point at 57° 15'N latitude and 001° 00'W longitude, then due south to a point at 56° 30'N latitude and 001° 00'W longitude and then in a westerly direction to a point on the east coast of Scotland at 56° 30'N latitude and 002° 41.32'W longitude (Carnoustie).
Explanatory Note

(This note is not part of the Order)

This Order partially revokes the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1995 (“the principal Order”) which prohibited—
(a)fishing for or taking scallops within the area designated in the Schedule to that Order (article 4);
(b)movement of such shellfish out of that area (article 5); and
(c)landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such shellfish from the designated area within the United Kingdom (article 6).
The effect of this Order is to remove completely the prohibition from fishing for, taking, moving, landing, using in food production and supplying the shellfish affected by the principal Order from the area designated in the Schedule to this Order.
