The Birmingham Heartlands Hospital National Health Service Trust (Transfer of Trust Property) Order 1995

The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities formerly managed by the East Birmingham Health Authority resulting from the establishment of the East Birmingham Hospital National Health Service Trust(2) now called the Birmingham Heartlands Hospital National Health Service Trust(3), having consulted the North Birmingham Health Authority(4) and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Birmingham Heartlands Hospital National Health Service Trust (Transfer of Trust Property) Order 1995 and shall come into force on 10th August 1995.

(2) In this Order—

“the Authority” means the North Birmingham Health Authority;

“the Trust” means the Birmingham Heartlands Hospital National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the Authority and the Trust on 10th January 1995, which schedule has been signed on behalf of both the Authority and the Trust.

Transfer of trust property

2.  On 10th August 1995 the trust property shall be transferred from the Authority to the Trust.

Explanatory Note

(This note is not part of the Order)
This Order transfers to the Birmingham Heartlands Hospital National Health Service Trust on 10th August 1995 trust property formerly held by the North Birmingham Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, NHS Trust Unit, Room 1W29, Quarry House, Quarry Hill, Leeds LS2 7UE.
