DANGEROUS DRUGS
The Misuse of Drugs (Amendment) Regulations 1995

The Secretary of State, in exercise of the powers conferred on him by sections 7, 10 and 31 of the Misuse of Drugs Act 1971(1), after consultation with the Advisory Council on the Misuse of Drugs, hereby makes the following Regulations:

1.  These Regulations may be cited as the Misuse of Drugs (Amendment) Regulations 1995 and shall come into force on 1st September 1995.

2.  The Misuse of Drugs Regulations 1985(2) shall be amended as follows:

(a)in paragraph 1(a) of Schedule 1, by the insertion, after the words “Cannabinol derivatives”, of the words “not being dronabinol or its stereoisomers”;

(b)in paragraph 1 of Schedule 2, by the insertion, after the word “Dipipanone” of the word “Dronabinol”; and

(c)in paragraph 1 of Schedule 4, by the omission of the word “Propylhexedrine”.

3.  The Misuse of Drugs (Amendment) Regulations 1986(3) shall be amended by the omission, from regulation 2(6)(c), of the words ““Propylhexedrine” and”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Misuse of Drugs Regulations 1985 by transferring dronabinol and its stereoisomers from Schedule 1 to Schedule 2. This follows the removal of dronabinol and its stereoisomers from the Schedule of designated drugs to which section 7(4) of the Misuse of Drugs Act 1971 applies, in the Misuse of Drugs (Designation) (Variation) Order 1995 (S.I. 1995/2047). These Regulations also remove propylhexedrine from Schedule 4 to the 1985 Regulations, in consequence of the removal of propylhexedrine from control under the 1971 Act by the Misuse of Drugs Act 1971 (Modification) Order 1995 (S.I. 1995/1966).
