The Street Works (Registers, Notices, Directions and Designations) (Amendment No. 3) Regulations 1995

The Secretary of State for Transport as respects England and the Secretary of State for Wales as respects Wales, in exercise of their powers under 64(1) and (2) and 104(1) of the New Roads and Street Works Act 1991(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

1.  These Regulations may be cited as the Street Works (Registers, Notices, Directions and Designations) (Amendment No. 3) Regulations 1995 and shall come into force on 11th September 1995.

2.  The Street Works (Registers, Notices, Directions and Designations) (Amendment No. 2) Regulations 1995(2) are revoked.

3.  The Street Works (Registers, Notices, Directions and Designations) Regulations 1992(3) shall be amended as set out in regulations 4 and 5 below.

4.  In regulation 13(1)(a) for the words “under section 1 or 9 of the Road Traffic Regulation Act 1984”(4) there shall be substituted the words “under section 1, 6 or 9 of the Road Traffic Regulation Act 1984” and the words “for at least one hour” shall be inserted before the words “between 7.30 am and 9.30 am” and before the words “between 3.30 pm and 7.00 pm”.

5.  For regulation 13(1)(d) there shall be substituted—

“(d)The street is a priority route, or a street which the Director considers is likely to be affected by a priority route, and in respect of which prohibitions or restrictions of waiting have been imposed, or parking places have been designated, in the implementation of the relevant local plan or trunk road local plan, to the extent that the Director asks the street authority to designate it as traffic-sensitive, and during the times at which any such prohibitions, restrictions or designations are in force.

(dd)The street is a priority route, or a street which the Director considers is likely to be affected by a priority route, but in respect of which no prohibitions or restrictions of waiting have been imposed or parking places designated in the implementation of the relevant local plan or trunk road local plan, to the extent that the Director asks the street authority to designate the street as traffic-sensitive between the hours of 6.30 am and 7.30 pm on any day except Sunday.”

6.  In regulation 13(4) there shall be inserted after the definition of “critical gyratory or roundabout system” the following definitions—

““the Director”, “local plan”, “priority route” and “trunk road local plan” have the meanings given to those expressions in section 82(1) of the Road Traffic Act 1991(5)”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations make amendments to regulation 13 of the Street Works (Registers, Notices, Directions and Designations) Regulations 1992 (S.I. 1992/2985), which sets out the criteria for designating streets as traffic-sensitive pursuant to section 64 of the New Roads and Street Works Act 1991. They revoke and replace the Street Works (Registers, Notices, Directions and Designations) (Amendment No. 2) Regulations 1995 (S.I. 1995/1154) which contained unintended errors.
Paragraph (1)(a) of regulation 13 is amended to refer to road traffic regulation orders in Greater London made pursuant to section 6 of the Road Traffic Regulation Act 1984 and it is made clear that the prohibition or restrictions of the parking of vehicles referred to in that paragraph must be for at least one hour during the hours specified.
New paragraphs (1)(d) and (dd) are substituted to enable a street authority in Greater London to designate a street as traffic-sensitive where it is a priority route (within the meaning of the Road Traffic Act 1991) or in the opinion of the Traffic Director for London is one which is likely to be affected by a priority route.
