Coming into force in accordance with article 1
The Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (Nos.2, 3 and 4) Orders 1995 Partial Revocation Order 1995 and shall come into force at 17.00 hours on 12th September 1995.

Revocations

2.  The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.4) Order 1995(2) is revoked insofar as it designates any part of the area set out in Schedule 1 to this Order.

3.  The Orders specified in Schedule 2 to this Order are revoked.

SCHEDULE 1
The area of sea within a line drawn from a point on the Mainland of Orkney at Costa Head at 59° 09.25'N latitude and 003° 13.0'W longitude to a point at Sacquoy Head on the Island of Rousay at 59° 12'N latitude and 003° 04.5'W longitude then to a point at Noup Head on the Island of Westray at 59° 20.0'N latitude and 003° 04.25'W longitude, then along the line of mean high water springs on the southern shore of the Island to a point at Weather Ness at 59° 14.75'N latitude and 002° 50.0'W longitude, then to a point at Red Head on the Island of Eday at 59° 15.0'N latitude and 002° 45.5'W longitude, then to a point at Whale Point on the Island of Sanday at 59° 17.55' latitude and 002° 37.0'W longitude and then along the line of mean high water springs on the west, south and east coasts of the Island to a point at 59° 15.25'N latitude and 002° 30.0'W longitude, then in a southerly direction to a point at 59° 00.0'N latitude and 002° 30.0'W longitude, then in an easterly direction to a point at 59° 00.0'N latitude and 001° 00.0'W longitude, then in a southerly direction to a point at 58° 15.0'N latitude and 001° 00.0'W longitude, then in a westerly direction to a point at 58° 15.0'N latitude and 002° 30.0'W longitude, then in a northerly direction to a point at 59° 00.0'N latitude and 002° 30.0'W longitude and then in a westerly direction to a point on the Mainland of Orkney at 59° 00.0'N latitude and 002° 54.0'W longitude, then along the line of mean high water springs on the northern and eastern shore of the Mainland to a point at Costa Head at 59° 09.25'N latitude and 003° 13.0'W longitude.

Explanatory Note

(This note is not part of the Order)

This Order partially revokes the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.4) Order 1995 (“the (No.4) Order”)and revokes in their entirety the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Orders 1995 noted in Schedule 2 which prohibited—
(a)fishing for or taking shellfish within the areas designated in the Schedules to those Orders (article 4);
(b)movement of such shellfish out of those areas (article 5); and
(c)landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such shellfish from the designated areas within the United Kingdom (article 6).
The effect of this Order is to remove the prohibition from fishing for, taking, moving, landing, using in food production and supplying the shellfish affected by each of the Orders, in the case of the (No. 4) Order from the area designated in Schedule 1 to this Order and in the case of the Orders listed in Schedule 2 from the whole of the areas specified in those Orders.
