ENTERPRISE ZONES
The East Midlands Enterprise Zones (North East Derbyshire) (Designation) Order 1995

Whereas the North East Derbyshire District Council, acting pursuant to Schedule 32 to the Local Government, Planning and Land Act 1980(1) (“the Schedule”), on 25th July 1995 by resolution adopted the East Midlands Enterprise Zone No. 1 (Holmewood) Scheme, the East Midlands Enterprise Zone No. 2 (Holmewood) Scheme and the East Midlands Enterprise Zone No. 3 (Holmewood) Scheme, subsequently publishing an advertisement complying with paragraph 3 of the Schedule in the Derbyshire Times (a newspaper circulating in the area to which the schemes relate) on 3rd August 1995, and in the London Gazette on 4th August 1995;
And whereas six weeks has expired since the first publication of that advertisement, and no application has been made to the High Court under paragraph 4 of the Schedule in respect of any of the schemes;
Now therefore the Secretary of State for the Environment, in exercise of the powers conferred on him by paragraph 5 of the Schedule and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Order:—
Citation, commencement and interpretation
1. This Order may be cited as the East Midlands Enterprise Zones (North East Derbyshire) (Designation) Order 1995 and shall come into force on 3rd November 1995.
2. In this Order:
“the Council” means the North East Derbyshire District Council;
“the map” means the map prepared in duplicate, marked “Map referred to in the East Midlands Enterprise Zones (North East Derbyshire) (Designation) Order 1995”, and signed by an Under Secretary in the Department of the Environment, one duplicate of which has been deposited and is available for inspection at the principal offices of the Council and the other at the offices of the Secretary of State for the Environment; and
“the Zone areas” means the three areas—
(a)
the boundaries of which are represented by the outside edge of a black line edged internally with a stippled band on the map; and
(b)
to which the East Midlands Enterprise Zone No. 1 (Holmewood) Scheme and the East Midlands Enterprise Zone No. 2 (Holmewood) Scheme and the East Midlands Enterprise Zone No. 3 (Holmewood) Scheme respectively relate.
Enterprise zones in North East Derbyshire
3. The Zone areas are hereby designated as enterprise zones, and the Council is hereby designated as the enterprise zone authority for those zones.
Period of designation
4. Designation under this Order shall take effect on 3rd November 1995, and the designated areas shall remain enterprise zones for a period of 10 years from that date.

Explanatory Note
(This note is not part of the Order)
This Order designates as enterprise zones three areas which are located in the Holmewood area of the district of North East Derbyshire, and which have been the subject of three enterprise zone schemes adopted by the North East Derbyshire District Council (the East Midlands Enterprise Zone No. 1 (Holmewood) Scheme, the East Midlands Enterprise Zone No. 2 (Holmewood) Scheme and the East Midlands Enterprise Zone No. 3 (Holmewood) Scheme).
The designation is effective for a period of 10 years.
he location and areas of the enterprise zones are shown on the plan forming part of this note. The detailed map referred to in article 2 may be inspected at the principal offices of the North East Derbyshire District Council, and at the offices of the Secretary of State for the Environment.
