The Secretary of State, on application to him by the River Nith District Salmon Fishery Board, having carried out all necessary consultations, complied with all necessary procedures and considered the representations and objections made as required by paragraphs 3, 4 and 7 of Schedule 1 to the Salmon Act 1986(1), as applied by section 8(5) of that Act, in exercise of the powers conferred on him by section 8 of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the River Nith Salmon Fishery District (Baits and Lures) Regulations 1995 and shall come into force on 1st January 1996.

Specification of baits and lures and area of application

2.  Natural prawns and shrimps (whether fresh or preserved, dyed or natural colour) and any part thereof are, in relation to the River Nith and its tributaries within the River Nith salmon fishery district upstream of a line drawn across the River Nith between grid reference 97507483 (the house situated at 28 Riverside Drive, Dumfries) and grid reference 97537470 (the north east corner of Kingholm Playing Fields, Dumfries), specified for the purposes of the definition of “rod and line” in section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951(2).

Explanatory Note

(This note is not part of the Regulations)
These Regulations specify natural prawns and shrimps and any part of them for the purposes of the definition of “rod and line” in section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951. They apply to the River Nith and its tributaries within the River Nith salmon fishery district upstream of a line drawn across the River Nith between grid reference 97507483 and grid reference 97537470. The effect is to prohibit, for the whole of each year, the use of natural prawns and shrimps (or any part of them) as bait when fishing by rod and line for salmon and sea trout.
