The Secretary of State, in exercise of the powers conferred on him by section 5 of the Environmental Protection Act 1990(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement, extent and interpretation

1.—(1) These Regulations may be cited as the Environmental Protection (Determination of Enforcing Authority Etc.) (Scotland) Amendment Regulations 1995, shall come into force on 10th November 1995 and shall extend to Scotland only.

(2) In these Regulations “the 1992 Regulations” means the Environmental Protection (Determination of Enforcing Authority Etc) (Scotland) Regulations 1992(2).

Amendment of regulation 3 of the 1992 Regulations

2.  In regulation 3 of the 1992 Regulations, after paragraph (1) there shall be inserted—

“(1A) Where, in respect of any prescribed process, the enforcing authority is not determined by the provisions of paragraph (1) above, the enforcing authority for that process shall be the chief inspector.”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations, which extend to Scotland only, amend regulation 3 of the Environmental Protection (Determination of Enforcing Authority Etc) (Scotland) Regulations 1992 to provide that, in circumstances where paragraph (1) of that regulation does not identify the enforcing authority in respect of a particular prescribed process, the enforcing authority for that process shall be the chief inspector.
