The Secretary of State, in exercise of the powers conferred on him by section 3(1) of the Plant Health Act 1967(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Soft Fruit Plants (Scotland) Revocation Order 1995 and shall come into force on 1st December 1995.

Revocation of the Soft Fruit Plants (Scotland) Order 1991

2.  The Soft Fruit Plants (Scotland) Order 1991(2) is hereby revoked.

Explanatory Note

(This note is not part of the Order)
The Soft Fruit Plants (Scotland) Order 1991 (“the 1991 Order”) prohibits the sale of blackcurrant, strawberry and raspberry plant propagating material in Scotland unless it has been certified as conforming to prescribed standards of purity and health.
This Order revokes the 1991 Order in consequence of the making of the Marketing of Fruit Plants Regulations 1995 (S.I. 1995/2653) which apply throughout Great Britain and which lays down minimum conditions to be met by fruit plants and fruit plant propagating material intended for fruit production in implement of Council Directive 92/34/EEC of 28th April 1992 (O.J. No. L157, 10.6.92, p.10) on the marketing of fruit plant propagating material and fruit plants intended for fruit production and Commission Directive 93/48/EEC of 23rd June 1993 (O.J. No. L250 7.10.93, p.1) setting out the schedule indicating the conditions to be met by fruit plant propagating material and fruit plants intended for fruit production pursuant to Council Directive 92/34/EEC.
