The Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Amendment Regulations 1995

The Registrar General, in exercise of the powers conferred upon him by sections 13(1), 19(2), 22(1), 32(1), 40(2), 54(1)(b) and 56 of the Registration of Births, Deaths and Marriages (Scotland) Act 1965(1) and of all other powers enabling him in that behalf and with the approval of the Secretary of State, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Amendment Regulations 1995 and shall come into force on 1st January 1996.

Interpretation

2.  In these Regulations, “the principal regulations” means the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Regulations 1965(2).

Amendment of the principal regulations

3.  For the form set out in Schedule 1 to the principal regulations(3), there shall be substituted the form set out in Schedule 1 to these Regulations.

4.  For the form set out in Schedule 2 to the principal regulations(4), there shall be substituted the form set out in Schedule 2 to these Regulations.

5.  For the form set out in Schedule 5 to the principal regulations(5), there shall be substituted the form set out in Schedule 3 to these Regulations.

6.  For the form set out in Schedule 10 to the principal regulations(6), there shall be substituted the form set out in Schedule 4 to these Regulations.

7.  For the form set out in Schedule 16 to the principal regulations(7), there shall be substituted the form set out in Schedule 5 to these Regulations.

8.  For the form set out in Schedule 17 to the principal regulations(8), there shall be substituted the form set out in Schedule 6 to these Regulations.

Revocations

9.—(1) Regulations 3, 4, 5, 6 and 8 of and Schedules 1, 2, 3, 4 and 6 to the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Amendment Regulations 1971(9) are hereby revoked.

(2) Regulation 4 of and Schedule 1 to the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Amendment Regulations 1994(10) is hereby revoked.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Regulations 1965 (“the principal regulations”) by substituting six revised forms for the corresponding forms prescribed by the principal regulations. The revised forms make provision for female occupations to be inserted on the forms where appropriate. Other changes are minor and include changes to the style and layout of the forms.

In section 40(2), the references to “the Adopted Children Register maintained under section 22(1) of the Adoption Act 1958” and to “adoption” are to be read, in relation to parental orders and applications for such orders, in accordance with paragraph 2(1) of Schedule 2 to the Parental Orders (Human Fertilisation and Embryology) (Scotland) Regulations 1994 (S.I. 1994/2804); section 56 contains a definition of “prescribed” relevant to the exercise of statutory powers under which these Regulations are made.
