The Misuse of Drugs (Amendment No.3) Regulations (Northern Ireland) 2014

The Department of Health, Social Services and Public Safety, makes the following Regulations in exercise of the powers conferred by sections 7, 10, 22 and 31 of the Misuse of Drugs Act 1971 (1) as adapted by sections 7(9), 31(4) and 38 of that Act and now vested in it (2) and after consultation with the Advisory Council on the Misuse of Drugs in accordance with section 31(3) of that Act.

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Misuse of Drugs (Amendment No. 3) Regulations (Northern Ireland) 2014 and shall come into operation on 11th November 2014.

(2) The Interpretation Act (Northern Ireland) 1954 (3) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendments to the Misuse of Drugs Regulations (Northern Ireland) 2002

2.  The Misuse of Drugs Regulations (Northern Ireland) 2002 (4) shall be amended as provided by regulation 3.

3.  In paragraph 1(a) of Schedule 1 (which specifies controlled drugs subject to the requirements of regulations 14, 15, 16, 18, 19, 20, 23, 26 and 27) after “9-(Hydroxymethyl)-6, 6-dimethyl-3-(2-methyloctan-2-yl)-6a, 7, 10, 10a-tetrahydrobenzo[c]chromen-1-ol” insert—

“Khat”

EXPLANATORY NOTE

(This note is not part of the Regulation)

These Regulations amend the Misuse of Drugs Regulations (Northern Ireland) 2002 in order to add Khat to Schedule 1 of those Regulations. The Schedule in which a controlled drug is placed primarily affects the extent to which the drug can be lawfully imported, exported, produced, supplied or possessed and dictates the record keeping, labelling and destruction requirements in relation to that drug.
