The A65 Trunk Road (Horse Pasture Laithe to Heber Barn) (Detrunking) Order 1993

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:—

1.  The length of trunk road described in the Schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be a trunk road as from the date on which the Secretary of State notifies the County Council of North Yorkshire that the new trunk road is open for through traffic.

2.  In this Order:

(a)all measurements of distance are measured along the route of the relevant highway; and

(b)(i)“classified road”, “as a classification for a highway”, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

(ii)“the deposited plan” means the plan numbered HA10/YHCPD60 marked “The A65 Trunk Road (Horse Pasture Laithe to Heber Barn) (Detrunking) Order 1993” signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London, SW1P 3PY;

(iii)“the new trunk road” means the highway to be constructed by the Secretary of State in pursuance of the A65 Trunk Road (Gargrave Bypass) Order 1990(3); and

(iv)“the trunk road” means the north-west of Doncaster to Kendal Trunk Road (A65).

3.  This Order shall come into force on 23rd July 1993 and may be cited as the A65 Trunk Road (Horse Pasture Laithe to Heber Barn) (Detrunking) Order 1993.

SCHEDULELENGTH OF TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the Trunk Road ceasing to be a trunk road is about 0.23 kilometres in length and is in the District of Craven in the County of North Yorkshire. It extends from a point 760 metres west of the bridge over the Leeds and Liverpool Canal known as Anchor Bridge (marked ‘A’ on the deposited plan) to a point 530 metres west of the said bridge (marked as ‘B’ on the deposited plan).
