The A35 Trunk Road (Tolpuddle to Puddletown Bypass) (Detrunking) Order 1993

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:—

1.  This Order shall come into force on 30th July 1993 and may be cited as the A35 Trunk Road (Tolpuddle to Puddletown Bypass) (Detrunking) Order 1993.

2.  From the date on which the Secretary of State notifies the County Council of Dorset that the new trunk roads are open for through traffic:

(a)each length of trunk road described in the Schedule to this Order, and shown on the deposited plan by broad striped hatching and a reference letter, shall cease to be trunk road;

(b)the length of trunk road described in paragraph 1 of that schedule, and shown on the deposited plan by the reference letter A, shall be a classified road.

3.  In this Order:

(a)all measurements of distance are measured along the route of the relevant highway;

(b)(i)“classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

(ii)“the deposited plan” means the plan numbered HA10/2/SDM84 marked “The A35 Trunk Road (Tolpuddle to Puddletown Bypass) (Detrunking) Order 1993” signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House,43 Marsham Street, London SW1P 3PY;

(iii)“the new trunk roads” has the same meaning as in The A35 Trunk Road (Tolpuddle to Puddletown Bypass and Slip Roads) Order 1993(3).

SCHEDULELENGTH OF TRUNK ROADS CEASING TO BE TRUNK ROADS

The lengths of trunk road ceasing to be trunk road are those lengths of the A35 Trunk Road in the Districts of Purbeckand West Dorset in the County of Dorset as follows:—
1.  The length labelled ‘A’ on the deposited plan from a point 185 metres east of the centre line of its junction with Bridleway No BR48 eastwards for a distance of 7190 metres to a point on the eastern side of its junction with Classified Road B3390.

2.  The length labelled ‘B’ on the deposited plan from a point 120 metres east of the centre line of its junction with Classified Road B3390 eastwards for a distance of 360 metres to a point on the eastern side of its junction with Classified Road C110.
