The National Health Service and Community Care Act 1990 (Commencement No. 3 and Transitional Provisions) (Scotland) (Amendment) Order 1992

The Secretary of State, in exercise of the powers conferred upon him by section 67(2) and (3) of the National Health Service and Community Care Act 1990(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the National Health Service and Community Care Act 1990 (Commencement No. 3 and Transitional Provisions) (Scotland) (Amendment) Order 1992.

(2) In this Order—

“the principal Order” means the National Health Service and Community Care Act 1990 (Commencement No.3 and Transitional Provisions) (Scotland) Order 1990(2).

Amendment of the principal Order

2.  Paragraph (5) of article 2 of the principal Order (appointed days)—

the words “31st March 1992” shall be omitted and there shall be substituted therefor the words “30th June 1992”.

Explanatory Note

(This note is not part of the Order)
This Order amends the National Health Service and Community Care Act 1990 (Com mencement No.3 and Transitional Provisions) (Scotland) Order 1990 to postpone from 31st March 1992 to 30th June 1992 the coming into force of section 27(1) and (2) of the National Health Service and Community Care Act 1990 insofar as these provisions concern a State Hospital Management Committee within the meaning of the Mental Health (Scotland) Act 1984.
