The A39 Trunk Road (Wadebridge Bypass) (Detrunking) Order 1991

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The lengths of trunk road described in the Schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk road as from the date on which the Secretary of State notifies the County Council of Cornwall that the new trunk road is open for through traffic. The length of trunk road described in paragraph 2 of that Schedule shall be classified a classified road as from that date.

2.  In this Order:–

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (i) “classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
(ii)“the deposited plan” means the plan numbered HA10/– 2SWM64, marked “The A39 Trunk Road (Wadebridge Bypass) (Detrunking) Order 1991”, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London, SW1P 3PY;

(iii)“the new trunk road” means the new highway which the Secretary of State proposes to construct mentioned in article 1 of the A39 Trunk Road (Wadebridge Bypass) Order 1991(3); and

(iv)“the trunk road” means the A39 Trunk Road.

3.  This Order shall come into force on 4th April 1991 and may be cited as the A39 Trunk Road (Wadebridge Bypass) (Detrunking) Order 1991.

SCHEDULELENGTHS OF THE TRUNK ROAD CEASING TO BE TRUNK ROAD

The lengths of the trunk road ceasing to be trunk road are situated in and near Wadebridge from a point east of Whitecross to a point east of Ball in the District of North Cornwall in the County of Cornwall and are as follows:–


Reference letter on the deposited plan

1.  That length of the trunk road from a point 37 metres south-west of its junction with the unclassified road to Edmonton, eastwards to a point 210 metres east of that junction.

2.  That length of the trunk road from a point 365 metres east of its junction with the unclassified road to St. Breock, eastwards to a point 123 metres north-east of its junction with the classified road C114 to Egloshayle.

3.  That length of the trunk road from a point 258 metres north-east of its junction with the classified road C114 to Egloshayle, eastwards to a point 60 metres east of its junction with the unclassified road to Tregorden.
