Her Majesty, in exercise of the powers conferred on Her by section 20(1) and (3) of the Merchant Shipping Act 1979(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Merchant Shipping (Prevention of Oil Pollution) (Hong Kong) (Amendment) Order 1988 and shall come into force on 24th November 1988.

2.  Schedule 2 to the Merchant Shipping (Prevention of Oil Pollution) (Hong Kong) Order 1984(2) (extending to Hong Kong, with modifications, Articles 3(1) and 6 of the Merchant Shipping (Prevention of Oil Pollution) Order 1983(3)) is amended by inserting in Article 3(1) as extended, after the word“Protocol”, the words“and amendments to the Annex to the Protocol adopted by the Marine Environment Protection Committee of the International Maritime Organization at its 20th Session by resolution MEPC 14(20)”.

Explanatory Note

This Order amends the Merchant Shipping (Prevention of Oil Pollution) (Hong Kong) Order 1984 to enable the Governor of Hong Kong to make regulations to give effect in Hong Kong to the amendments to the Annex to the Protocol of 1978 relating to the International Convention for the Prevention of Pollution from Ships 1973 adopted on 7th September 1984 by the Marine Environment Protection Committee (“MEPC”) of the International Maritime Organization at its 20th Session. The amendments adopted by MEPC are contained in resolution MEPC 14(20), which may be obtained from the International Maritime Organization, 4 Albert Embankment, London SE1 7SR.
